Ryan White C.A.R.E. Act services for the term of July 1, 2007 through June 30, 2008.  Sufficient appropriations have been included in the FY 07-08 adopted budget.  There is no net County cost.
 
Background: The Ryan White C.A.R.E. Act provides direct emergency services for people living with HIV disease.  Services include, but are not limited to, information, referrals and/or arrangement of outpatient medical care, skilled nursing, medication management, diagnosis and treatment of common medical and mental conditions, and addressing nutrition issues to include direct food purchases as well as support to local food banks in El Dorado County.  Staff is available on a 24 hour basis for client medical emergencies.
 
Reason for Recommendation: El Dorado County Ryan White services are subcontracted out to Sierra Foothills AIDS Foundation, an agency with staff who have expertise in this specialized type of service and with whom the County has enjoyed a longstanding, successful relationship.  
 
This agreement is retroactive to July 1, 2007 due to the additional time needed by staff to evaluate the availability of funding from Sacramento County, which informed the Department in late July that funding was to be reduced.  Complications with Sierra Foothills AIDS Foundation regarding the resignation of the former Executive Director (ED) and subsequent appointment of the current ED delayed the negotiation process further.  The Department made every effort to bring this agreement to the Board as quickly as possible upon receipt of signed documents from Sierra Foothills AIDS Foundation on September 25th and agendized the agreement for the meeting of October 30; however, the Purchasing Agent disapproved the item after conducting a third-party review of the contract.  The Department addressed the issues involved and moved quickly to resubmit the contract for the earliest available Board meeting.
 
The Purchasing Agent has coordinated the outside review of the contractor's qualifications to perform the needed services with Adrienne Rogers, Ryan White Care Program of Sacramento County.   Initial review of the contract by Ms. Rogers identified changes that needed to be made as a result from Ryan White Care Act Legislation Passed by Congress in December 2006 as well as other agency references that needed correcting.  The Department has made the required changes to the agreement to be in compliance with the Ryan White Care Act.  Ms. Rogers concurs that Sierra Foothill Aids Foundation has demonstrated its ability to perform the work based on prior experience with the contractor, qualifications of the contractor, and the availability of the contractor to perform the services required of the department.  
 
The Purchasing Agent has determined that it is appropriate to dispense with any competitive selection processes for services performed by Sierra Foothill Aids Foundation as they are the sole provider for these service in our region.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.5 and 7.10.
 
Action to be taken following Board approval: Board Chairman to sign three (3) original documents where indicated; Board Clerk to return two (2) original documents to Public Health; Public Health to distribute fully executed documents to appropriate parties.
