Fiscal Impact/Change to Net County Cost: Funding is included within FY 2007-08 adopted budget for Alcohol/Drug Treatment services.  Compensation for Prop 36 services under agreement #622-PHD0607 (Progress House) shall be for $6,912; compensation for alcohol and drug treatment services under agreement #592-PHD0407 (Progress House) and 589-PHD0407 (EDCA Lifeskills) shall be $73,294 and $17,397 respectively.
 
Background: The County annually contracts with local non-profit agencies for the provision of alcohol and drug treatment services.  Depending on the number and origin of funding streams that make the provision of these services possible, the County may contract with a single vendor multiple times for similar services.  The El Dorado County Proposition 36 Program, which allows qualifying non-violent drug offenders the option of alcohol/drug treatment instead of incarceration, is one such program in particular.  It was implemented in July 2001 and continues to be overseen by the County Public Health Department.  Additionally, the County receives funding from the State's Drug Medi-Cal Program.  Subsequent treatment services are subcontracted out to various local non-profit agencies, including Progress House, Inc and EDCA Lifeskills.  
 
These services are entitlements, or are guaranteed to clients upon request or by Court order.  As a result, the amount of service provided by each vendor, is often difficult to estimate when individual contract terms begin.  Therefore, contracts such as those mentioned above are usually amended at a later date to ensure providers are fully compensated for the services they provide.  However, due to the time needed by these agencies to account for the total amount of services provided, those amendments usually are not executed until after the original contracts have expired.
 
Upon advice by Counsel, the Department proposes to revise its method of compensating vendors for services provided under expired contracts.  As opposed to amending expired, prior year contracts, Counsel recommended the Department amend its active, current year contracts with affected vendors to compensate them for services provided during the prior contract term.
 
Amendment I to Agreement #622-PHD0607, which has a term of July 1, 2007 through December 31, 2007, shall compensate Progress House for services provided prior to that term in FY 06/07, funded by the State's Prop 36 program.  Amendments I to Agreements #592-PHD0407 and 589-PHD0407, which have an identical term to the aforementioned agreement, shall compensate Progress House and EDCA Lifeskills for services provided prior to that term in FY 06/07, which were funded by Drug Medi-Cal.
 
In accordance with Board of Supervisors Policy C-17, Section 7.4.2, the Purchasing Agent concurs with the department's request to amend this agreement.  Amendment I calls for an increase in the not to exceed amount from $231,126.00 to $304,420.00.  
 
Outside review of the contractor's qualifications to perform the needed services and the review of any competitive selection process is not required as the amendment simply calls for final payment to the vendor based on actual costs incurred so that the department can fully reimburse the contractor for their fiscal year 2006-2007 cost report settlement.    
 
The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.
 
Action to be taken following Board approval:  Chairman to sign three (3) copies of each attached amendment; Board Clerk's Office to return two (2) fully executed copies of each amendment to Department; Department to distribute as appropriate; Auditor-Controller to expedite payment to Progress House and EDCA Lifeskills for services rendered in FY 06/07.
