Background:   The Sheriff's Office has been working with Procurements & Contracts and County Counsel for almost one year to get an invoice paid for outside legal services provided to the Sheriff in November of 2006.  The Sheriff is granted two (2) hours of free legal representation from the Law Offices of Jones & Mayer LP in Fullerton, California, through his annual membership in the California State Sheriff's Association.  The Sheriff exceeded the two (2) free hours and is being billed by the Law Offices of Jones & Mayer for an additional 20.1 hours of legal services totaling $2,608.75.  Staff failed to adaquately monitor the number of hours utilized on this issue.   Procedures have been put in place so that we do not exceed these hours in the future.
The conflict staff faced when submitting the invoice for payment was the contract for legal services was between Jones & Meyer and the California State Sheriff's Assiciation, not the County of El Dorado, or the Sheriff.
 
Reason for Recommendation: County Counsel has been successful in executing a retroactive Agreement #553-S0811, between the County of El Dorado and Jones & Meyer LP for the services rendered to the Sheriff between the period covering November 1, 2006 and January 31, 2007.  
 
Action to be taken following Board approval:  The Chair will sign the Agreement; Procurements and Contracts will create the encumberance; the Sheriff will submit the invoice to the Auditor for payment.
