Fiscal Impact/Change to Net County Cost: Funding is included within FY 2007-08 Approved Budget for the Alcohol/Drug Treatment Program.  There is no net County cost.
 
Background: The El Dorado County Proposition 36 Program, which allows qualifying non-violent drug offenders the option of alcohol/drug treatment instead of incarceration, was implemented in July 2001 and continues to be overseen by the County Public Health Department.  Treatment services for the Program are subcontracted out to various local non-profit agencies, including Sierra Recovery Center. These services are provided to clients upon request or by Court order.  
 
Reason for Recommendation:  This amendment increases the total not to exceed amount of the Agreement to make additional Prop 36 funds available for services that were originally to be paid for through a separate agreement funded by the State's Offender Treatment Program (OTP).  However, due to the type of Drug Court model used by Superior Court in South Lake Tahoe, staff determined that Sierra Recovery Center was ineligible to receive OTP funding from the State and was prompted to appropriate unallocated Prop 36 funds to this agreement to ensure drug and alcohol treatment services would continue in South Lake Tahoe through June 30, 2008.  Given that the scope and term remain the same, staff determined that amending the contract was appropriate.
 
Action to be taken following Board approval:  Chairman to sign two (2) copies of the attached amendment; Board Clerk's Office to return one fully executed copy to Department; Department to distribute as appropriate.
