Fiscal Impact/Change to Net County Cost: Funding made available in the Air Quality Managment District FY 2008-09 budget via a General Fund contribution from Deparment 15.

Reason for Recommendation:The Environmental Management Department (EMD) and AQMD have utilized the legal services of Dongell Lawrence Finney, a Limited Liability Partnership firm, for the past four years. The firm provides legal and legislative support to the AQMD regarding existing issues and new developments in the field of Naturally Occurring Asbestos (NOA). Developments such as the El Dorado Hills NOA Health Consultation Study which may be released shortly by the Agency for Toxic Substances and Disease Registry (ATSDR), or the upcoming regulatory modifications to the asbestos sampling methodology expected to be promulgated by the California Air Resources Board (CARB) in early 2009, are issues that may require the expertise and support of Dongell Lawrence Finney, LLP.

The Department/AQMD recommends the Board make findings that in accordance with County Charter Article II, Section 210b(6) that it is appropriate to obtain an outside consultant for the provision of specialty research and advisory services regarding Naturally Occurring Asbestos.
