Fiscal Impact/Change to Net County Cost: Has no impact on NCC as funds are budgeted from the ERDS Special Revenue Fund per Government Code 27397 (c) (1).  
 
Background: This is the third amendment to the original Department of Justice MOU of 2005.  Our participation will continue annually until either party (County or DOJ) does not wish to continue the agreement.   Fees are based upon a pro-rata cost divided equally among the participating counties; based upon the number of documents recorded annually.  
 
Reason for Recommendation:  Electronic Recording will enable to Recorder-Clerk to become more efficient in recording certain real estate transactions and will ultimately be more secure, save money and, will benefit the taxpayers of El Dorado County.  While the total not to exceed amount of the Agreement is within the Purchasing Agent's signature authority, the Agreement requires Board approval because it is perpetual.  
 
Action to be taken following Board approval: The Recorder-Clerk respectfully requests that the Board of Supervisors approve and cause to be signed the Fiscal Year 08/09 Amendment III to the Memorandum of Understanding with the Department of Justice.
