Fiscal Impact/Change to Net County Cost:
Funding for this Agreement is provided by the Shingle Springs Band of Miwok Indians Tribal Agreement.  There is no net cost to the County General Fund associated with this agenda item.
 
Background:
Capital Improvement Program Project # 53113 is Phase 2 of a larger plan to add High Occupancy Vehicle (HOV) Lanes to U.S. Highway 50 from El Dorado Hills to Shingle Springs. The project is being developed jointly by the County and Caltrans and includes construction of HOV lanes in the median of U.S. 50 from west of Bass Lake Road to Ponderosa Road. The total project cost, including Engineering, Plans, Specifications, and Estimate (PS&E), Right of Way (ROW), Construction, and Construction Management, is estimated at $54,750,000.  
 
On February 13, 2007, the Board ratified a Letter-of-Intent sent to Caltrans allowing work to begin on the process of building HOV lanes on U.S. Highway 50 from Bass Lake Road to the Ponderosa Road.  This Agreement provides for payment of invoices associated with that work within thirty (30) days of payment to County by Shingle Springs Band of Miwok Indians per the Tribal Agreement, and thereafter pays Caltran's monthly invoices for current actual work costs. The first payment  was made by the Tribe in December 2009 and it has taken until now to complete the COOP.
 
Reason for Recommendation:
The Transportation Department (Department) is recommending approval and execution of this Cooperative Agreement (COOP) with Caltrans to assist in meeting the goal of delivering Phase 2 of the U.S. Highway 50 HOV Lane Project. This agreement defines the roles and obligations of both El Dorado County and Caltrans for the PS&E and ROW activities for HOV lanes on U.S. Highway 50 from west of Bass Lake Road to Ponderosa Road.  Phase 2 Project construction will be the subject of a future amendment to this COOP or a separate COOP.  
 
The County has received the first payment from the Shingle Springs Band of Miwok Indians and will pay Caltrans thirty (30) days after execution of this COOP by all parties and after receipt and acceptance of itemized invoices detailing services rendered.  The County is the lead agency on this project and Caltrans will provide, at no cost to the County, encroachment permits in preparation for Ready to List activities.  
 
Pursuant to the El Dorado County Charter, Section 210b (6), the County may enter into any contract or agreement in cases where the Agreement is with or among any other governmental entities or agencies.
 
In accordance with the Feasibility Analysis, the Department is not required to notify an employee's association regarding this Agreement.
 
Action to be taken following Board approval:
1. The Board Chair will sign four (4) originals of Cooperative Agreement (County AGMT 09-52808, Caltrans District Agreement No. 03-0348).
 
2. The Board Clerk will forward four (4) originals of the partially-executed Cooperative Agreement to the Department to send to Caltrans for their review, approval, and signature.
 
3. A fully executed original Agreement will be returned to the Board Clerk for filing.
