Fiscal Impact/Change to Net County Cost:   The mandatory County match will be satisfied through in-kind services provided by the Offices of the District Attorney and Public Defender; budget for these services is included in the FY 2009-10 budget.  A budget transfer request to increase the Health Services Department budget by $200,000 is included with this Board item.  In addition, the Probation Department will be providing supervision, monitoring and testing services for the DUI Court Program in the amount of $6,000; this increase in the Probation Department budget for FY 2009-10 has been incorporated in the attached budget transfer request.
 
The grant has a two year term, and services will be provided during that two year period.  However,  since the grant monies will be allocated to the County in a lump sum at the beginning of the grant period, the budget transfer request reflects the entire amount for fiscal year 2009-10; unused funds at the end of the current fiscal year will be carried forward into the second year of the grant term and budgeted in FY 2010-11 for required services.
 
Background:    Since February 2008, the County of El Dorado has provided a highly successful DUI Court Program that is focused on residents with either two DUI convictions in a five year period, or three-or-more DUI convictions during their lifetime.  This Drug Court Discretionary Grant award is intended to enhance services provided under the DUI Treatment Court Program. As noted on the Superior Court website, "DUI Court participants receive treatment that focuses on alcohol use as a chronic disease and is therefore intensive in nature.  Professional addiction specialists ensure that rehabilitation comes in the form of disease management and care."  
 
The required County match will be satisfied by in-kind services provided by the Offices of the District Attorney and Public Defender in support of the Drug Court Program; budget supporting the participation of these Departments is included in the FY 2009-10 budget.
 
This grant award is retroactive to September 1, 2009.  Award documents were received by the Department on October 19, 2009; staff immediately processed for County Counsel review, and submitted for the next available Board date.
 
Reason for Recommendation:   Acceptance of this grant award will enhance ongoing DUI Treatment Court activities, including increased participant access to longer stays in treatment, implementation of a comprehensive program evaluation to more accurately track program outcomes, increased supervision and monitoring, and increased access to sober living environments for participants.
 
Action to be taken following Board approval:
1.  Chairman to sign three (3) original grant award documents.
2.  Board Clerk's Office to return two (2) signed original documents to Department.
3.  Department to mail one (1) signed document to the Department of Justice - Office of Justice Programs, and retain one (1) for files.
