Fiscal Impact/Change to Net County Cost:

The total construction cost associated with the proposed El Dorado Irrigation District (EID) waterline relocation work is estimated at $309,660.  EID shall be responsible for seventy-seven and a half percent (77.5%) of the $309,660, representing $239,987 for (1) their portion of construction costs associated with the waterline installation work, (2) their portion of the fifteen percent (15%) supplemental construction items estimate which includes flagging, traffic control, water and dust pollution controls, construction management, and mobilization/demobilization costs, and (3) their portion of a ten percent (10%) project contingency.  The County’s twenty-two and a half percent (22.5%) share of the actual total waterline installation work is estimated at $69,673, and will be funded by the 2004 General Plan TIM Fee Program and Highway Bridge Program.  There is no net cost to the County General Fund associated with this agenda item.

 

Background:

The Department plans to make improvements to Green Valley and North Shingle Roads.  A segment of the existing Gold Hill Intertie (GHI) 20-inch waterline is in conflict with the proposed improvements.  Approximately 950 feet of new 20-inch waterline is proposed to be installed within the new roadway to replace and abandon approximately 826 feet of the existing GHI.  Additionally, two EID 6-inch waterlines require relocation within public utility easements at County cost.  EID has requested the County include the installation of EID facilities in the County’s construction bid package, award documents, and construction contract for the proposed Project.

 

A Mitigated Negative Declaration (MND) for the Green Valley Road Bridge (25C-0038) Replacement at Tennessee Creek / N. Shingle Road Intersection Improvements was adopted by the Board on December 9, 2008 (Legistar 08-1720). The relocation of the portion of the GHI was not included in the MND.  Additionally, the two 6-inch waterlines included in the environmental analysis were not specifically included in the MND project description.

 

Reason for Recommendation:

The Department supports the inclusion of EID’s work in the County’s construction package in order to better coordinate the construction within the roadway segment, shorten the duration of the impact to the traveling public, and reduce overall impacts to the County and EID that would be associated with preparing and administrating two separate contracts.

 

Under the proposed agreement, EID will reimburse the County for the portion of the existing waterline within the existing County right-of-way.  The County will incur the costs of the waterline required to be relocated due to conflicts with the proposed improvements in the areas where EID has prior rights.  Pursuant to this basis of cost-sharing, EID is responsible for 77.5% of the relocation costs and the County is responsible for 22.5% of the costs for relocation of the GHI.

 

CEQA Guidelines Section 15164, Addendum to an EIR or Negative Declaration, allows El Dorado County to prepare an addendum to the previously adopted MND if only minor technical changes or additions are necessary or none of the conditions described in CEQA Guidelines Section 15162 calling for the preparation of a subsequent EIR or negative declaration have occurred.  The ground-disturbing effects associated with the GHI waterline replacement occur within the area impacted by the County project.  Mitigation measures cited in the MND will reduce environmental effects of the GHI to a less than significant level.  No new significant effects will occur and the severity of previously identified effects will not be increased by completion of the GHI waterline relocation. The impacts of the two 6-inch waterline relocations were previously analyzed in the MND and mitigation measures included to reduce the impact to less than significant.  Therefore, none of the conditions described in CEQA Guidelines Section 15162 would occur. 

 

Action to be taken following Board approval:

1. The Board Chair will sign two originals of the Construction Responsibility and Reimbursement Agreement, AGMT 09-52686, between the County of El Dorado and the El Dorado Irrigation District.

2.  The Board Clerk will forward one fully executed original Agreement to the Department for further processing.

3.  Following County Counsel review and approval and Board adoption, the Department will file a Notice of Determination (NOD) for the Addendum to the Mitigated Negative Declaration for the Green Valley Road Bridge (25C-0038) Replacement at Tennessee Creek /N. Shingle Road Intersection Improvements Project.

4.  The Department shall incorporate the EID waterline replacement in the construction contract documents for Green Valley Road at Tennessee Creek - Bridge Replacement Project (Project #77109).
