Fiscal Impact/Change to Net County Cost:  This Amendment increases the Agreement by $71,500 for a total amount of $130,000. The Mental Health Division (MHD) is responsible for paying the Contractor the total amount due for specialty mental health services and subsequently billing the State for Medi-Cal/EPSDT reimbursement.  There is no Net County Cost associated with this Agreement.

 

Compensation for Services:  Payments are made to Contractor based upon monthly invoicing at specified billing rates, as detailed on Page 3 of the original Agreement, for actual services performed per contract requirements.

 

Contract Termination:  This Agreement includes the County’s standard Fiscal Considerations termination language, as well as a provision for the County to terminate the Agreement without cause upon seven (7) calendar days written notice.

 

Background:  Therapeutic Behavioral Services (TBS) is an intensive behavioral mental health service available to children/youth with serious emotional challenges who are under age 21 and who are eligible for Medi-Cal benefits.  TBS can help children/youth and parents/caregivers, foster parents, group home staff, and school staff learn new ways of reducing and managing very challenging behaviors as well as strategies and skills to increase the kinds of behavior that will allow children/youth to be successful in their current environment.

 

TBS is designed to help children/youth and parents/caregivers (when available) manage these behaviors utilizing short-term, measurable goals based on the needs of the child/youth and family. TBS interventions may be available 24 hours a day, 7 days a week, as required.

 

TBS is utilized to assist children to maintain in their current placements (avoiding the need for placement in a higher level, more restrictive setting), and/or to return children from a higher level placement to a less restrictive setting within the shortest amount of time possible.

 

JDT Consultants has been successfully providing TBS for County minors since March 2007.

 

Reason for Recommendation:  This one year extension of the term and increase in the not-to-exceed amount of the Agreement will allow continuation of services for youth currently receiving treatment, and will provide for anticipated use throughout FY 11-12.  The contract Amendment will allow the MHD to meet its obligations to provide these specialty mental health services required for seriously emotionally disturbed youth.


In accordance with Board of Supervisor’s Procurement Policy C-17 Section 7.10, Health Services coordinated the review of the scope of services along with the contractor's qualifications within the last three years and has provided the results to the Procurement & Contracts Division.

 

Action to be taken following Board approval:

 

1.                     Chair to sign three (3) original Amendments I to Agreement 048-S0811.

2.                     Board Clerk’s Office to return two (2) original Amendments to the Health Services Department, Mental Health Division.

3.                     Mental Health Division to distribute as appropriate.
