Fiscal Impact/Change to Net County Cost
No change.  The Agreement is funded by Federal and State dollars with required County match met primarily with realignment resources.  Funds were budgeted for prior fiscal years and are budgeted for FY 2012-13.
 
Compensation
Payments to contractor are made within forty-five (45) days following the County's receipt and approval of itemized invoices identifying services rendered.  Compensation is based upon specified billing rates for actual services performed and documented per contract requirements.  
 
Termination
Agreement for Services 449-S1010 includes the County's standard Fiscal Considerations termination language as well as a provision for the County to terminate the Agreement without cause in seven (7) calendar days upon written notice.  
 
Background  
The original Agreement for Services 449-S1010 was executed by the Purchasing Agent on May 28, 2010 in an amount not-to-exceed $40,000. Amendment I to the Agreement was executed by the Board on January 11, 2011 to increase the not-to-exceed amount to $175,000. Due to the addition of services and the increase in the use of the services of this vendor, Amendment II increased the not-to-exceed amount to $275,000 on September 13, 2011.
 
Reason for Recommendation
The Health and Human Services Agency, Social Services Division ("HHSA") is recommending the continued use of this vendor's services as Tahoe Turning Point, Inc. is one of a limited number of available vendors in the South Lake Tahoe area that provides substance abuse testing, classes, training programs and therapeutic counseling services.  Amendment III to Agreement for Services 449-S1010 amends Article II, Scope of Services, adding additional services that will benefit referred clients and Article III, "Compensation for Services," increasing the contract's not-to-exceed compensation by an additional $50,000 to a not-to-exceed amount of $325,000 in order to reflect the addition of the new services combined with an increased and on-going demand for the services provided by this vendor.  
 
Purchasing Agent Recommendations
The Purchasing Agent has determined that it is appropriate to dispense with a competitive selection process in accordance with Board of Supervisor's Policy C-17, Sections 7.5 and 7.10 and concurs with the department's request to amend Agreement for Services 449-S1010 in accordance with Board of Supervisors Policy C-17, Section 7.4.1.  
 
Action to be taken following board approval
1.  Chair to execute two (2) copies of the approved Amendment III to Agreement for Services 449-S1010
2.  Board Clerk's Office to return one (1) original Amendment III of the Agreement to HHSA Contracts Unit at 3057 Briw Road.
3.  HHSA to distribute as appropriate.
