DEPARTMENT RECOMMENDATION:

Chief Administrative Office, Facilities Division, recommending the Board approve and authorize the Chair to sign a Grant of Easement Agreement and Certificate of Acceptance with the City of South Lake Tahoe for a Permanent Multi-Use Trail easement and Temporary Construction easement across portions of a property owned by the County (APN 027-010-31), located on the north side of Lake Tahoe Boulevard (Highway 50), east of Fremont Avenue in South Lake Tahoe, California to complete a Class I Bike path.

 

DISCUSSION / BACKGROUND:

The City of South Lake Tahoe is requesting to acquire a Permanent Multi-Use Trail Easement and a Temporary Construction Easement across portions of County property, identified as APN 027-010-31-100.  The Permanent Multi-Use Trail easement will include approximately 247 square feet located at the southern border of the property, along with frontage on Lake Tahoe Boulevard (U.S. Highway 50).  The easement will not affect access to the County's property in any way.  The Temporary Construction easement will include approximately 261 square feet adjacent to the north of proposed Multi-Use Trail easement.  This Temporary Construction easement  is proposed to be for a term of six months to provide access to install improvements associated with the proposed bike improvements within the Permanent Multi-Use Trail easement.  The property will be returned in a reasonably similar condition as it was before.  The County property is currently vacant and improved with asphalt paving.  The City has completed the construction of the Class I Bike path and the easement is the final phase.

CAO RECOMMENDATION:

Facilities is a Division of the Chief Administrative Office, and the Office concurs with staff's recommendation.

 

FINANCIAL IMPACT:

There are no fees or assessments relative to this easement.  There is no fiscal impact or net cost to the County General Fund associated with this agenda item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair's signature on the Grant of Easement and Certificate of Acceptance.

2) The Clerk of the Board will complete the All Purpose Notary Acknowledgment provided for the Easement Agreement and forward to the Recorder/Clerk's office for recordation.

3) The Clerk of the Board will send one executed and recorded copy of the Grant of Easement Agreement, the Certificate of Acceptance, and the All Purpose Notary Acknowledgment to the Diviison.
