1) Receive and file the Final Draft Response to the 2015/16 Grand Jury Final Report; and, following the incorporation of any changes directed by the Board at this meeting; and

2) Authorize and direct staff to submit the Board of Supervisors' Final Response to the 2015/16 Grand Jury Final Report to the Presiding Judge of the Superior Court.

DEPARTMENT RECOMMENDATION

Chief Administrative Office recommending the Board approve the Final Response to the 2015-2016 Grand Jury Final Report (Attachment 2A), and authorize its transmittal to the Superior Court, and to publish the response on the County's web-site.

 

DISCUSSION / BACKGROUND

The 2015-2016 Grand Jury published several individual Final Reports on various subjects during month of June, and published it's consolidated Final Report on June 30, 2016. Under the California Penal Code, sections 933, the Board of Supervisors must provide a response to the Presiding Judge within 90 days of date that a Final Report is made available to the public. The attached draft response has been prepared in the form prescribed by Penal Code section 933.05 and addresses the findings and recommendations of the Grand Jury which are under the jurisdiction of the Board of Supervisors. Because the first individual Final Report was made public on June 9, 2016, staff is recommending that the County finalize the full Response to the 2015-2016 Grand Jury Report by the deadline for responding to the first Final Report, which is September 7, 2016. 

 

Reports included in the Final Report that warrant a response from the Board of Supervisors include:

 

                     21st Century County Charter

                     FENIX, Icarus Naught

                     West Slope Animal Shelter: Best in Show

                     Americans with Disabilities Act County Compliance

                     Sheriff’s Headquarters: How Old is Too Old

                     Proposed Public Safety Headquarters

                     Juvenile Detention Facilities Inspection

                     El Dorado County Jails Inspection

 

Board Policy A-11 guides the development of the Board of Supervisors response to Grand Jury Reports. The Chief Administrative Office has worked with relevant departments to compile the Draft Response for the Board's consideration.  The Board considered the Initial Draft Response on August 16, 2016.  The Final Draft Response is provided as Attachement 2A to this report.  A copy of the Final Draft Response has been transmitted to the current Grand Jury Foreman along with information regarding the date and time that this item will be heard.

 

Pursuant to Board policy, a draft cover letter to the Presiding Judge of the Superior Court is also provided as Attachment 2B to this report.

 

Action(s) to be taken following Board approval: The Final Response to the 2015-2016 Grand Jury Report will be submitted to the Presiding Judge of the Superior Court prior to September 7, 2016, and will be published on the County's web-site. 

 

Additionally, pursuant to Board Policy B-10, at the end of each fiscal year, before adjourning, the Grand Jury may identify to the County CAO up to four of its individual reports that it wishes to have published in their entirety in the newspaper. The County is to then arrange for the complete printed publication of those four reports in the newspaper with the largest circulation on the West Slope of the County (and any affiliate publications), as well as the newspaper with the largest circulation in the Lake Tahoe area of the County (and any affiliate publications). The County will also arrange for concurrent publication of an index that lists all individual reports in each of the newspapers identified above. This year, the Grand Jury identified the four reports as: Landscape and Lighting Assessment Districts in El Dorado Hills (El Dorado Hills CSD respondent); 21st Century County Charter; Fenix, Icarus Naught; and Americans with Disabilities Act County Compliance.  Therefore, staff will arrange for publication of the four reports identified by the 2015-2016 Grand Jury.  The publications will also direct readers where to find electronic and printed copies of the entire Final Grand Jury Report, including related responses.

There are no viable alternatives to considering the Final Response.

The Response has been prepared in conjunction with affected departments.

FINANCIAL IMPACT

There is no direct financial impact related to the consideration of this Final Draft Response, or in approving the Final Response.  There may be a finanical impact related to implementation of certain Grand Jury Recommendations; however, such impact will be identified as staff assesses needs for future action, and will be discussed in future staff reports prior to implementation.
