DEPARTMENT RECOMMENDATION

Surveyor's Office recommending the Board adopt a Resolution of Vacation for Abandonment of Easement 16-010 to abandon a portion of the public utility easements located on Lots 56 and 57 of "River Park Estates Unit 2",  recorded at Book C of Subdivisions at Page 101, identified as Assessor's Parcel Numbers (APN) 036-563-06 and 036-563-07, requested by the owners,  Daniel Gallagher and Rhonda Blanchard.

 

DISCUSSION / BACKGROUND

A request has been submitted by Daniel Gallagher and Rhonda Blanchard, owners of APN 036-563-06 and 036-563-07, requesting that the County of El Dorado, Board of Supervisors, vacate a portion of the public utility easements located on the subject properties. Said easements are more particularly described in Exhibit A, and depicted on Exhibit B of the attached Resolution.

 

The public utility easements, as shown on Lots 56 and 57 of "River Park Estates Unit 2", recorded at Book C of Subdivisions at Page 101 were offered to the County of El Dorado by, Inter County Title Co. A California Corporation and Union Bank A California Corporation, on July 30, 1962. The easements were accepted by the County of El Dorado on August 13, 1962 and the Subdivision Map recorded on August 13, 1962.

 

ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 16-010. By utilizing this alternative, Daniel Gallagher and Rhonda Blanchard, who are in the process of merging their two parcels (BLA 16-003) would have the easements running down the center of their resulting parcel, thereby overburdening it.

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Southwest Gas Corporation, South Tahoe Public Utility District and Liberty Utilities have not used said easements for the purpose for which they were dedicated and find no present or future need exists for said easements and do not object to their vacation, and to that end, have all issued letters to this effect. 

 

CAO RECOMMENDATION

It is recommended that the Board approve this item. 

 

FINANCIAL IMPACT

There is no fiscal impact associated with this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the Resolution.

2) Clerk of the Board to record the Resolution and attached Exhibits at the County Recorder’s Office.

3) Clerk of the Board to return one (1) copy of the recorded Resolution and attached Exhibits to the Surveyor's Office for further processing.
