Community Development Agency, Transportation Division, recommending the Board consider the following pertaining to the Pleasant Valley Road (SR 49)/Patterson Drive Intersection Signalization Project, CIP 73320:
1) Authorize the Chair to sign the Grant and Easement Deeds granting the parcels and easements acquired by the County for the Project to the California Department of Transportation;
2) Authorize the Community Development Agency Director, or designee, to execute escrow instructions and any other related escrow documents and/or any other documents pertaining to the transaction, including payment of title and escrow fees if necessary; and
3) Authorize the Community Development Agency Director, or designee, to extend the date of closure of escrow upon mutual agreement of both parties, if necessary.
FUNDING: Developer In-Lieu Fees, El Dorado/Diamond Springs Road Impact Fund, Road Fund, State Highway Operations and Protection Program, State Transportation Impact Mitigation Fees, State-Local Partnership Program, and Traffic Impact Mitigation Fees (West Slope). (No Federal Funds)

DEPARTMENT RECOMMENDATION
Community Development Agency, Transportation Division (Transportation), recommends the Board approve the transferring of the parcels and easements for the Pleasant Valley Road State Route 49 (SR 49)/Patterson Drive Intersection Signalization Project (Project) as detailed in the Project's Cooperative Agreement 03-0473 (Cooperative Agreement) between the County and the California Department of Transportation (Caltrans). Granting these parcels and easements to Caltrans releases the County of both the liability and maintenance of these parcels, easements, and improvements.
DISCUSSION / BACKGROUND
Transportation completed construction of the Project in October 2014. The Project was accepted by the Board on April 28, 2015 (Item 31). As part of the Project, the Board approved a Cooperative Agreement with Caltrans on December 18, 2012 (Item 33). This Agreement requires that the fee title parcels and highway easement rights acquired by the County as part of the Project that are within SR 49 be transferred to Caltrans upon completion of the Project.
The County acquired two (2) fee title parcels and two (2) highway easements within SR 49 for the Project. Transportation worked closely with Caltrans on the Grant Deeds and Easement Deeds. The transfer of fee title parcels and highway easements to Caltrans will facilitate the completion of the required right-of-way mapping.
ALTERNATIVES
If the parcels and easements are not transferred to Caltrans, the County would be responsible to maintain the roadway and intersection signalization improvements and could be liable for any incidents or accidents that occur.
OTHER DEPARTMENT / AGENCY INVOLVEMENT
County Counsel has reviewed and approved the Grant and Easement Deeds, and Caltrans per Cooperative Agreement.

Approve as recommended.
FINANCIAL IMPACT
There is no cost to transfer the Grant and Easement Deeds.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair's signature on each of the two (2) Grant Deeds.
2) The Clerk of the Board will obtain the Chair's signature on each of the two (2) Easement Deeds.
3) The Clerk will return the original Grant and Easement Deeds to Loren Massaro, Transportation Division, Headington Engineering, for processing to Caltrans for signature.
