DEPARTMENT RECOMMENDATION
Community Development Agency, Transportation Division (Transportation), recommending the Board approve and authorize the Chair to sign the Long Term License Agreement between the California Tahoe Conservancy (CTC) and El Dorado County, CTC Resolution 16-09-04_El Dorado County (Agreement), for County use of land parcels owned by the CTC to construct and maintain drainage improvements under the Meyers Stream Environment Zone/Erosion Control Project, Contract PW 16-31121, CIP 95179 (Project).
DISCUSSION / BACKGROUND
Execution of the proposed Agreement will allow Transportation to construct some of the Project’s improvements on CTC property. Execution of the Agreement will also require Transportation to maintain the improvements on CTC property for a period of twenty years after installation. The CTC-owned parcels covered under the proposed Agreement are Assessor Parcel Numbers 033-582-05, 033-603-03, 034-221-14, 034-401-22, 033-601-04, 033-603-06, 034-221-16, 034-402-02, 033-602-03, 033-611-01, 034-270-39, 034-791-01, 033-603-01, 034-020-24, 034-401-03, 034-802-01, 033-603-02, 034-215-08, and 034-401-15. Exhibit A of Agreement further describes the proposed improvements planned for these parcels.
Project improvements include grading and revegetation activities, drainage improvements, and water quality features. Transportation may begin construction on the Project as early as July 1, 2017.
ALTERNATIVES
The Board could choose to not approve the proposed Agreement. Transportation would then revise the plans to relocate the improvements to County right-of-way or delete the improvements from the Project. This would increase the cost and delay delivery of the Project.
OTHER DEPARTMENT / AGENCY INVOLVEMENT
County Counsel and Risk Management have reviewed and approved the proposed Agreement.
CAO RECOMMENDATION
Approve the Department's recommendation.
FINANCIAL IMPACT
There are no fees or assessments relative to the subject Agreement. The proposed improvements to the CTC parcels are budgeted in the current Capital Improvement Program and contribute to the County's compliance with its National Pollutant Discharge Elimination System permit. Future maintenance of the improvements will be accommodated within Transportation's annual operating budget.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk will obtain the Chair's signature on each of the two (2) originals of the Agreement.
2) The Clerk will complete the All Purpose Notary Acknowledgement provided.
3) The Clerk will send the two (2) originals of the partially-executed Agreement and the All Purpose Notary Acknowledgement to Transportation-Tahoe Engineering Unit (Patty Scott), for processing to the CTC for signature.
4) Transportation will supply the Clerk with a fully executed Agreement for submittal to the County Recorder-Clerk’s Office for recordation.
