HEARING - Chief Administrative Office recommending the Board adopt and authorize the Chair to sign Resolution 109-2016 making certain findings as required under the Mitigation Fee Act (Cal. Gov. Code §66000 et seq.) related to the development impact mitigation fee collected by the County on behalf of the El Dorado Hills Community Services District.
FUNDING: There is no fiscal impact to the County related to this action.

DISCUSSION / BACKGROUND
At the request of the El Dorado Hills CSD, the Board of Supervisors established a development impact mitigation fee on June 3, 1997, pursuant to Resolution No. 112-97. The Mitigation Fee Act (Cal. Gov. Code 66000 et seq.) requires reports annually and every five years following the first deposit of the fee. The last report to the Board was on June 25, 2013 (file #13-0767). The attached resolution makes findings which are required by the Act (66001(d)) to be made every five years. The findings are supported by a report on fee activity that has been produced by the CSD, adopted by the CSD Board of Directors, and reviewed by County staff. The resolution of the CSD Board adopting the report is included as Attachment C.
