Title

Supervisor Frentzen recommending the Board direct the Chief Administrative Officer and the Interim Director of the Community Development Agency to review the current process used to develop and negotiate Development Agreements, and to report back to the Board with a defined process and best practices within 45 days.

Body

Background

A development agreement is a contract between a local jurisdiction and a property owner, usually a developer.  The agreement sets the standards and conditions that govern the development of the property. It provides certainty to the developer that his or her project will be isolated from changes in the jurisdiction’s zoning laws over the course of development, but it also contracts the developer to provide benefits to the county, such as infrastructure improvements, public open space, or monetary payment into funds, such as “in lieu” fees, in exchange for that certainty.

Recently, questions have been raised regarding the Development Agreement process in El Dorado County.

As a result, it would be beneficial for the Board to have an understanding of the process, and to ensure best practices are being followed.
