Title

Health and Human Services Agency, Administration and Finance Division, recommending the Board adopt and authorize the Chair to sign Resolution 056-2017, specific to the Emergency Medical Services Agency, Medical Marijuana Identification Cards.

FUNDING:   Fee for Service.

Body

Health and Human Services Agency (HHSA) recommending the Board adopt and authorize the Chair to sign Resolution 056-2017, to establish fees for Medical Marijuana Identification Cards dispensed by the Emergency Medical Services Agency, in compliance with Health and Safety Code Section 11362.755 as amended by Proposition 64, Section 5.3.

DISCUSSION / BACKGROUND:

At the Board of Supervisors meeting of August 30, 2016 (16-0805, Item 30), the Board received proposed fee changes as a result of a Fee Study, and adopted Resolution 143-2016 pertaining to fees for Animal Services, Resolution 145-2016 pertaining to fees related to the Behavioral Health Division, Resolution 146-2016 pertaining to fees for the Public Guardian program, and Resolution 147-2016 pertaining to fees for the Public Health Clinic, Laboratory, and Vital Statistics programs. Additionally, the Board directed staff to return to the Board on September 13, 2016 with revised Resolution 144-2016 regarding fees specific to the Emergency Medical Services Agency and Resolution 148-2016 regarding fees specific to the Senior Day Care and Senior Services Program.  Based on Board direction on August 30, 2016, staff prepared revised Resolutions 144-2016 and 148-2016 for Board consideration.

On September 13, 2016, HHSA had revised Resolution 144-2016 to update fees for EMT Certifications, Paramedic Initial Accreditations and Continuing Education Provider fees to be consistent with Sacramento County EMS Agency as represented in Attachment 2D.

In accordance with the Resolution 144-2016, EMS currently charges $142.00 in County Fees and $66.00 in State Fees for Medical Eligible Medical Marijuana Identification Cards (MMIC) totaling $208.00. These fees are reduced by 50% if the patient is a Medi-Cal beneficiary.

Effective November 8, 2016, Health and Safety Code Section 11362.755 was amended by Proposition 64, Section 5.3. This section states, “In no event shall the amount of the fee charged by a county health department exceed one hundred dollars ($100) per application or renewal.” Resolution XXX-2017 shall supersede Resolution 144-2016 and establish fees in accordance with the new laws.

ALTERNATIVES:

The Board could choose to decline the proposed Resolution, thereby retaining the existing fee structure.  However, the Department fees would not be in compliance with the new law as codified in Health and Safety Code Section 11362.755.

OTHER DEPARTMENT / AGENCY INVOLVEMENT:

County Counsel.

CAO RECOMMENDATION:

It is recommended that the Board approve this item.

FINANCIAL IMPACT:

Compliance with Prop 64 will reduce the fee charged by the County, thereby increasing Net County Cost for these services.

CLERK OF THE BOARD FOLLOW UP ACTIONS

Clerk of the Board to obtain signature of Chair on each of the adopted Resolutions; and return one certified copy of each adopted Resolution to the HHSA Contracts Unit at 3057 Briw Road.

STRATEGIC PLAN COMPONENT:

Health and Human Services Agency Strategic Plan Goal 2 - Fiscal Responsibility, Objective 2.2.1 - Develop an updated standardized structure for fees, fines, and services.
