Chief Administrative Office recommending the Board approve and authorize the Chair to sign Amendment I to the Employment Agreement By and Between County of El Dorado and Roger Niello, Interim Director of the Community Development Agency effective November 2, 2016, extending the term of the agreement through May 17, 2017, and reducing the salary to $5,780.80 per biweekly pay period for the period from May 1, 2017 through May 17, 2017.

 

DISCUSSION / BACKGROUND

In order to ensure the ongoing and efficient operations of the Community Development Agency following the resignation of the previous Director of the Community Development Agency on October 28, 2016, Roger Niello was appointed as Interim Director on November 1, 2016. The employment agreement stated that the appointment would be for a limited term to end no later than April 30, 2017. 

 

On February 28, 2017, the Board voted to 1) approve the reorganization of the Community Development Agency to include the following departments: Planning and Building Department, Environmental Management Department, Department of Transportation and Community Development Services Administration and Finance, 2) Adopt Resolution 038-2017 creating new job specifications, bargaining unit designation, and salary schedules for the positions of Director of Transportation, Director of Environmental Management, and Director of Planning and Building pending revisions to affected ordinances; 3) Adopt Resolution 039-2017 amending the Authorized Personnel Allocation adding a Deputy Chief Administrative Officer, Director of Transportation, Director of Environmental Management, and Director of Planning and Building and deleting the Director, Community Development Agency, Assistant Director, Community Development Agency, Transportation Division Director, Environmental Management Division Director, Development Services Division Manager and one Principal Administrative Analyst position, resulting in reductions in force effective July 1, 2017, pending revisions to affected ordinances; and 4) direct staff to revise and update Chapter 2 of the County Code to reflect the changes in organizational structure and designate appointed department heads pursuant to Section 404 of the Charter of the County of El Dorado, and return to the Board for adoption of affected ordinances and any required resolutions within 45 days.

 

On April 11, 2017, the Board approved the first reading of Ordinance 5051, amending El Dorado County Ordinance Code Titles 1, 2, 6, 8, 9, 10, 12, 110, 120, and 130 pertaining to the reorganization of the Community Development Agency, and continued the Ordinance to April 18, 2017 for Final Passage (Second Reading). The Ordinance establishes separate departments of Environmental Management, Planning and Building, and Transportation, designates the Director of Transportation, Director of Environmental Management, and Director of Planning and Building as Board-appointed department heads, and deletes references to the Community Development Director. The Ordinance goes into effect 30 days following the Final Passage, May 18, 2017.

 

The action to authorize the Chair to sign the amendment to the employment agreement would extend the limited term appointment of the CDA Interim Director to May 17, 2017, one day prior to the effective date of the CDA Reorganization Ordinance. It would also reduce the salary to be paid to Mr. Niello from $7,025.60 to $5,780.80 per biweekly pay period for the extended period of employment, from May 1, 2017 through May 17, 2017.

County Counsel has reviewed and approved this amendment.

 

CAO RECOMMENDATION

Approve and authorize the Chair to sign the Amendment to the Employment Agreement By and Between County of El Dorado and Roger Niello.

 

FINANCIAL IMPACT

There is no increase in net county cost because the salary for the Director of Community Development Agency is already budgeted.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

Clerk of the Board shall obtain the Chair's signature on the Amendment and provide two (2) fully executed copies to the CAO.
