DEPARTMENT RECOMMENDATION
Community Development Services, Department of Transportation, recommending the Board consider the following:
1) Approve and authorize the Chair to sign the Notice of Acceptance (NOA) with Sierra Nevada Construction, Inc. for the application of slurry seal as directed in Work Order 5;
2) Authorize the Clerk of the Board to release the Payment and Performance Bonds to the Surety upon notification from the Department of Transportation after the one-year guarantee period.
DISCUSSION / BACKGROUND
The County has contracted with Sierra Nevada Construction, Inc. for the application of slurry seal. Sierra Nevada Construction was awarded the bid for on-call application of type II latex modified slurry seal by the Board on June 10, 2014 (Item No. 11). Each year, the Department of Transportation (Transportation) issues work orders and designates slurry seal areas. In FY 2016/2017 the Contractor applied slurry seal on various roadways in the Zone of Benefit areas, as directed in Work Order No. 5. The projects were completed on June 14, 2017. Recordation of the NOA will start legal time frames for warranties, a lien period and return of retention monies. Recordation of the NOA will start the one-year time frame for releasing the Payment and Performance Bonds to the Surety.
The final cost for the slurry seal completed on Work Order 5 is estimated at $269,374.00. Transportation will be closing out Work Order No. 5 and will be finalizing the costs over the coming weeks. Any significant deviations from the estimate which exceed Transportation's allocated authority will be brought back for the Board for review and approval in a subsequent agenda item.
ALTERNATIVES
The Board could choose not to approve the NOA. Transportation has inspected the work and deemed the work complete. The NOA initiates the warranty period and the time period counter for the release of Payment and Performance Bonds. By not approving the NOA the Board would delay the release of the Bonds and extend the Contractor’s warranty period.

It is recommended that the Board approve this item.
FINANCIAL IMPACT
There is no change to Net County Cost associated with this item. Funding for the completed work was included in the adopted Fiscal Year 2016/17 Zone of Benefit Fund budgets.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will send the NOA for Work Order 5 to the Recorder/Clerk's Office for recordation within ten (10) days and forward a copy of the recorded NOA for the Work Order to the Department of Transportation, Headington Site, attention Cierra Garcia; and
2) One year after the recordation of the NOA, Department of Transportation will verify that all warranty work, if any, has been satisfactorily completed and will notify the Clerk of the Board in writing to release the Bonds.
