Health and Human Services Agency (HHSA), recommending the Board:

1) Approve the use of the Registered Dietitian agreement, attached hereto as Attachment B,  on an “as needed” basis pursuant to requirements established by the funder, California Department of Aging; and

2) Adopt and authorize the Chair to sign Resolution 156-2017, thereby delegating authority to the HHSA Director, or designee, to execute and administer Registered Dietitian agreements using Exhibit A to said Resolution.

DEPARTMENT RECOMMENDATION: 

Health and Human Services Agency (HHSA) recommending the Board approve the use of the Registered Dietitian agreement (Template) and adopt the Resolution authorizing the HHSA Director, or designee, to execute agreements using said Template on an “as needed” basis. 

 

On March 28, 2017, HHSA received an inquiry from California Department of Aging (CDA), requesting that we revise the current Registered Dietitian agreement to incorporate specific requirements.  A draft agreement was developed, approved by Counsel and Risk, and approved by CDA as meeting the requirements of the funding terms and conditions.   HHSA is recommending the Board approve this Registered Dietitian template to ensure compliance with funding requirements in the future.

 

Additionally, HHSA has determined that services provided under the Template satisfy the criteria defined in Chapter 3.13, Section 3.13.030 of the County Ordinance in that the work performed in accordance with CDA’s requirements is on an “as needed” basis; therefore, it is more economical and feasible to engage an independent contractor for registered dietitian services.

 

DISCUSSION / BACKGROUND:

The Older Americans Act passed in 1965 provides for community social services for older persons and authorizes a wide variety of service programs available through state and area agencies on aging, tribal organizations, and service providers.  The County is the designated Area Agency on Aging (AAA) for Planning and Service Area (PSA) 29 which encompasses the County of El Dorado.  HHSA administers AAA programs in the County which include various Older Americans Act Title III and Title VII senior services such as nutrition services, legal assistance, support services, elder abuse prevention, and disease prevention.

 

HHSA provides eligible seniors with hot, nutritious meals on certain weekdays in congregate meal sites located throughout the County.  In addition, for those eligible seniors that are medically or physically disabled, meals are delivered to their homes.  The registered dietitian ensures that the meals are in compliance with nutrition, sanitation, and related requirements under California Code of Regulations (CCR) Title 22, Title IIIC Elderly Nutrition Program, and Program Memo guidance from the California Department of Aging, at HHSA’s central kitchens and at each senior nutrition site.

 

In addition to the physical site inspections, the registered dietitian provides menu development, nutrition education, development of informational articles for publishing in the monthly Senior Times Newsletter, maintains records of nutrition education, and prepares reports of food preparation sites and non-food preparation sites.

 

ALTERNATIVES:

The Board could choose to disapprove the Resolution and the Registered Dietitian template agreement.

California Department of Aging, County Counsel, and Risk Management.

 

CAO RECOMMENDATION:

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT:

There is no Net County Cost associated with this Agenda item.  If the Template is approved, sufficient appropriations will be included in future budgets for the term of the resulting agreement for services.

1) Clerk of the Board to obtain signature of Chair on one (1) Resolution.

2) Clerk of the Board to return one (1) certified copy of the Resolution to the HHSA Contracts Unit at 3057 Briw Road.
