DEPARTMENT RECOMMENDATION

Community Development Services, Department of Transportation (Transportation), recommending the Board approve and authorize the Chair to sign retroactive State of California Standard Agreement CTA 17008 (Agreement) and Contractor Certification Clause CCC 04/2017 (Certification), collectively the private lease revenue transfer Agreement, with the California Tahoe Conservancy (CTC) for the term of July 1, 2017, through June 30, 2020, to allow $3,506 to be allocated to Transportation’s erosion control projects in the South Lake Tahoe region.

 

DISCUSSION / BACKGROUND

Pursuant to Government Code Section 66908.3, the CTC is authorized to lease acquired lands.  When such lands are within El Dorado County and are leased to private individuals or groups, the CTC must transfer 25 percent of the gross income of the leases to the County each year.  Pursuant to the Budget Act of 2017, Chapter14/17, the California State Legislature has appropriated $3,506 to the CTC for transfer to the County as private lease revenue for this fiscal year.  At least 50 percent of this amount is to be used for erosion control projects in the South Lake Tahoe region, as defined in Government Code Section 66905.5.  Transportation will allocate the entire $3,506 to erosion control projects.

 

The Agreement requires that the County sign the Certification regarding non-discrimination, drug-free workplace requirements, and other provisions for which certification is required when doing business with the State of California.  The County's current practices are consistent with these requisites.

 

The term of the Agreement is retroactive from July 1, 2017, and continues for a three-year term ending June 30, 2020.  Transportation did not receive the subject Agreement from the CTC until September 6, 2017.

OTHER DEPARTMENT / AGENCY INVOLVEMENT 

County Counsel has reviewed and approved the proposed Agreement and Certification.

 

CAO RECOMMENDATION

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

Approval of the Agreement will facilitate the provision of $3,506 for the County's use on erosion control projects in the South Lake Tahoe region.  There is no Net County Cost or match requirement associated with these funds.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board will obtain the Chair’s signature on the three (3) original sets of the private lease revenue transfer Agreement  and Certification.

2) Clerk of the Board will return all three (3) partially-executed original sets and a certified copy of the Minute Order to Transportation-Tahoe Engineering Unit, attention of Patty Scott, for forwarding to the CTC for review and approval.
