DEPARTMENT RECOMMENDATION

County Counsel recommends that the Board approve the revised conflict of interest code received from the El Dorado County Water Agency.

DISCUSSION / BACKGROUND

Local public entities within the county are required to review their conflict of interest codes and determine whether changes should be made in order to bring them up to date every two years.  Under state law, the Board of Supervisors acts as the “code reviewing body” and must review and approve the local public entities’ revised conflict of interest codes.  

The El Dorado County Water Agency’s conflict of interest code has not been updated since 2010, and was recently amended to update the list of designated employees that are required to file annual disclosure statements.  The revised conflict of interest code was submitted for approval by the Board of Supervisors as the code reviewing body.  County Counsel’s office has reviewed the revised conflict of interest code and finds that it is in accordance with state law.  The Board’s approval makes the revised conflict of interest code legally effective. 

 

ALTERNATIVES

If the Board does not approve the revised conflict of interest code, the Water Agency will be governed by its former adopted and approved code until such time as the revised code is approved by the Board.
