Health and Human Services Agency, Mental Health Division, recommending the Board adopt Resolution 066-2012 authorizing Certification Review Hearings and approving amended Chapter IV of the County Short-Doyle Plan Update, Part B, thereby notifying the California Department of Mental Health of a change in Certification Review Hearings in the County. This Resolution and Amendment to the Short-Doyle Plan specifies County of El Dorado procedures in conducting State-mandated Certification Review Hearings, and supersedes prior Resolution 149-83.

Fiscal Impact/Change to Net County Cost: There is no Net County Cost associated with Resolution ____-2012 and the Short-Doyle Plan Update.
Background: California Welfare and Institutions Code Section 5250 provides a sequential process called “certification review hearings” for persons detained on an involuntary civil commitment to a mental health institution. In May 1984, the County Board of Supervisors approved Resolution 149-83 and 142-84 concerning the 1983/1984 Short-Doyle Plan Update, Part B, which allowed certification review hearing proceedings to be conducted through the Superior Court rather than the County.
Reason for Recommendation: The Health and Human Services Agency, Mental Health Division (HHSA/MHD) is responsible for the Psychiatric Health Facility and clients held there via involuntary civil commitments. This Resolution ____-2012 and Amendment to Chapter IV of the Short-Doyle Plan Update authorizes Certification Review Hearings in the County of El Dorado and authorizes notification to the State Department of Mental Health of this change in process.
Action to be taken following Board approval:
1. Board Clerk’s Office to provide HHSA/MHD at 931 Spring Street two (2) certified resolutions
2. HHSA/MHD to submit Resolution and Amendment to Chapter IV of the Short-Doyle Plan Update to the State.
