Transportation Department recommending adoption of Resolution terminating and abandoning the Offer of Dedication from Russell-Promontory, LLC, for an easement for road and public utility purposes; and adoption of Resolution accepting the Irrevocable Offer of Dedication for a road right of way, including the underlying fee, along with a public utilities easement from Russell-Promontory, LLC, located on the property identified as APN 124-070-36 in El Dorado Hills.

Fiscal Impact/Change to Net County Cost: None. There is no net cost to the County General Fund associated with this agenda item.

Reason for Recommendation:
On November 20, 2001 the County of El Dorado Recorder's office inadvertently recorded an Offer of Dedication from Russell-Promontory, LLC, an Illinois limited liability company, to the County of El Dorado for an easement for road and public utility purposes, located on the property identified as Assessor's Parcel Number 124-070-36, and being more particularly described and depicted in Exhibits A and A-1, attached to said offer. Said offer was not submitted to the Department for processing; therefore, said offer was not reviewed and approved by the Department and subsequently presented to the Board of Supervisors for approval and acceptance. In addition, the Department has reviewed said offer and has determined that the right of way should be dedicated in fee, not as an easement.

The facts stated above require that said offer be terminated and abandoned and that a new Irrevocable Offer of Dedication be submitted. A new Irrevocable Offer of Dedication for a road right of way, including the underlying fee, along with a public utilities easement, has been submitted to the Department by Russell-Promontory, LLC. Russell-Promontory, LLC, is offering said road right of way and easement, as they are necessary for public purposes.
