Background:
On August 15, 2006, Agenda Item #71, the Board of Supervisors directed the Department of Transportation to process an abandonment, pursuant to Streets and Highways Code Section 8320(a)1 et seq., of the County Road known as Old River Road through APN's 006-231-13, 26, -27, and -28. The vacation is pursuant of the provisions of the Streets and Highways Code Section 8320 et seq., Chapter 3 of Part 3, Division 9 (General Vacation Procedures).

On June 5, 2007 your Board adopted Resolution 115-2007 entitled "Resolution of Intention to Vacate a Portion of Old River Road Coloma Townsite". It set a public hearing date for June 26, 2007 at 9:00 AM in the Board Chambers to receive public testimony in order to make the findings required under Section 8324 of the Streets and Highways Code.

Reason for Recommendation:
An error was created when a subdivision map was recorded on June 13, 1949 Map of Coloma Heights Resubdivision of Portions of Lots 2,5,6,7,8,10, & 11 Block 13 Coloma Townsite recorded in Book A of Maps, Page 89. New River Road was created and accepted by the County to provided access to said lots. Old River Road was superceded by the acceptance of New River Road and should have been vacated. Old River Road is not being used as a street or highway, no monies have been spent on said road, and it is not necessary for access to parcels APN's 006-231-13, -26, -27, and -28.
