DEPARTMENT RECOMMENDATION

Surveyor's Office recommending the Board adopt a Resolution of Vacation for Abandonment of Easement (AOE) 17-004 to abandon a slope, drainage and public utility easement on Lot 15 of "Ridgeview West Unit No. 3",  recorded at Book J of Subdivisions at Page 55, identified as Assessor's Parcel Number (APN) 120-680-15, requested by the owner,  Ajay Singh.

 

DISCUSSION / BACKGROUND

A request has been submitted by Ajay Singh, owner of APN 120-680-15, requesting that the County of El Dorado, Board of Supervisors, vacate a slope, drainage and public utility easement located on the subject property. Said easement is more particularly described in Exhibit A1 and depicted on Exhibit B1 and described in Exhibit A2 and depicted on Exhibit B2 of the attached Resolution.

 

The setback, slope, drainage and public utility easement, as shown on Lot 15 of "Ridgeview West Unit No. 3", recorded at Book J of Subdivisions at Page 55 was offered to the County of El Dorado by, Ridgeview West L.L.C., a California Limited Liability Company, on March 7, 2005. The easement was acknowledged and accepted by the County of El Dorado on July 12, 2005 and the Subdivision Map recorded on July 15, 2005.

 

ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 17-004. By utilizing this alternative, the owner of Assessor's Parcel 120-680-15, would be unable to purse any development that would impact these easements.

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Comcast, El Dorado Irrigation District and Pacific Gas & Electric have not used said easement for the purpose for which it was dedicated and find no present or future need exists for subject easement and do not object to its vacation, and to that end, have all issued letters to that letters to that effect.

 

Department of Transportation has not used said portion of the easement for the purpose for which it was dedicated and finds no present or future need exists for this portion of the  easement and does not object to its vacation, and to that end, has provided written approval to the County Surveyor’s Office.

 

CAO RECOMMENDATION

It is recommended that the Board approve this item.

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution to the Surveyor's Office for further processing.
