Fiscal Impact/Change to Net County Cost:

Funding for this contract is provided through the Road Fund and is included in the Fiscal Year 2008-2009 operating budget.  The $2,725 purchase price for the software (including sales tax and shipping cost) includes one concurrent license fee, so there are no additional fees associated with this License Agreement.  Although, the purchase of the software will be accomplished on a purchase order, California Department of Transportation (Caltrans) requires that the End User Software License Agreement be executed prior to shipping the software.  The requested action will have no impact to the General Fund net County Cost or to the Department's roadway maintenance efforts.

 

Reason for Recommendation:

CTBridgeTM is a frame analysis and design program that runs under the Windows XP® operating system and supports the Third Edition of the American Association of State Highway Transportation Officials (AASHTO) Load and Resistance Factored Design (LRFD) and Load Factor Design (LFD) design specifications.  CTBridgeTM is replacing Caltrans’ Bridge Design System (BDS) software as the everyday, mainstream longitudinal analysis and design program for Caltrans bridge engineers.

 

It is important to note that this software license agreement contains no standard indemnity provision, no warranty provision, a limitation of liability provision equal to the amount of the $2,500 license fee and it provides that the County will indemnify, defend and hold harmless the California Department of Transportation, its officers, agents and employees from any claims or actions related to use of the software and any claims related to bridge design.  

 

No maintenance or support is provided with this software package but the Department does not consider this a problem since the use of this software will be under the direction of a licensed engineer who will be responsible for the final design.  In addition, it is our design policy and practice to evaluate and verify engineering software results and to conduct independent check calculations for structure design of public work projects. The Caltrans Local Assistance federally funded bridge program also provides bridge design and engineering reviews upon request of local agencies.

 

On May 29, 2008, County Information Technology Department's Tom Straling approved this Agreement without comment.

 

The purchase of the CTBridgeTM software will allow the Department to reduce the proportion of design consultant time spent on County bridge projects, increasing the engineering staff's involvement and gaining more control over schedules. The Department’s federally funded bridge program is currently at $38,000,000 over five years and has staff ready to bring more engineering work in-house which cannot be done without this software.

 

Action to be taken following Board approval:

1.  The Board Chairman will sign two originals of CTBridgeTM End User Software License Agreement # AGMT 08-1698 with Caltrans.

 

2.  The Board Clerk will forward both partially-executed original Agreements to the Department for Caltran's review and approval.

 

3.  The Department will forward one fully-executed Agreement to the Board Clerk for filing.
