Title: Hearing to consider the following pertaining to property identified as APN 070-131-08, consisting of 10.11 acres in the Rescue area: Applicant: Donald and Suzanne McNeill (Agent: C.J. RECOMMENDED ACTION:  Planning Commission recommending the Board of Supervisors take the following action:  1. Adopt the negative declaration based on the initial study prepared by staff; 2. Approve Z07-0055 rezoning Assessor's Parcel Number 070-131-08 from Estate Residential Ten-Ace (RE-10) to Estate Residential Five-Acre (RE-5), based on the findings listed in Attachment 1; and 3. Approve P07-0049 based on the findings and subject to the conditions listed in Attachment 1.
 
Background: These applications were considered by the Planning Commission on November 13, 2008, and were unanimously (5-0) recommended for approval.
 
Rick Smith, adjacent neighbor, had no objections to the rezone application and felt it was a compatible use.
