Background:
On November 15, 2005 the Board approved establishment of a Juvenile Ranch/Camp and authorized for Chief Probation Officer to sign Juvenile Probation Camps Funding (JPCF) Program Agreement with Corrections Standards Authority.
 
Tahoe Youth and Family Services provides a "Program Therapist" who provides on-site counseling, services and support to the Challenge Program, Substance Abuse Counseling Program, and Family Reunification Program operated by the Probation Department located at the Juvenile Treatment Center in South Lake Tahoe.  Counseling services include individual and group counseling, family reunification services, Lifeskills, drug and alcohol counseling, and anger management.  
 
The Purchasing Agent coordinated an outside review of the contractor's qualifications to perform the needed services with Sally Williams, Children's Services Coordinator, El Dorado County Mental Health.  Ms. Williams concurred that Tahoe Youth and Family Services has demonstrated its ability to perform the work based on prior experience with the contractor, qualifications of the contractor, and the availability of the contractor to perform the services required of the department.  
 
The Purchasing Agent has determined that it is appropriate to dispense with any additional competitive selection processes for services performed by Tahoe Youth and Family Services as they are the sole provider for adolescent alcohol and drug services in the South Lake Tahoe area.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.5 and 7.10.
 
Reason for Recommendation:
The modification to this contract is requested due to the proposed reduction of the Juvenile Probation Camps Funding Program, which previously funded the alcohol and other drug counseling services to the Challenge Ranch Program located within the Juvenile Treatment Center in South Lake Tahoe.  The modification of this contract will reduce the services from 40 hours a week to 20 hours per week.  The Probation Department has selected Tahoe Youth and Family Services due to the unstable funding received from the State, which would allow Probation to cancel this contract should the funding be eliminated altogether.
 
The Probation Department plans to utilize revenue from out of county detainees to help fund the services of Tahoe Youth and Family Services, and develop a coordinated plan to incorporate the counseling services of the Health Services Department to eventually transition at the end of this contract.  Due to unstable funding sources presently used, continuing with the counseling services of Tahoe Youth and Family Services is strongly recommended.
 
The County is amending ARTICLE I, Scope of Services of Agreement #383-S0811, AMDT I, to include the right to amend the terms of the Scope of Services by providing notice to parties per ARTICLE XII, Notice to Parties.  On November 26, 2008 the Probation Department sent notice to Tahoe Youth and Family Services, that effective January 1, 2009, the requested services of 1 FTE "Program Therapist" shall be reduced to a maximum of twenty (20) hours per week.  This notice shall be memorialized by the approval of #383-S0811, AMDT I.   
 
383-S0811, Amendment I will increase term of agreement to a total of three years and shall cover the period of December 11, 2007 through December 10, 2010.  
 
Except as herein amended all other parts and sections of that Agreement #383-S0811 shall remain unchanged and in full force and effect.  
 
The County officer and manager with responsibility for administering this agreement is Joseph S. Warchol II, Chief Probation Officer and Steve Maxwell, Deputy Chief Probation Officer and Superintendent of the Juvenile Treatment Center, South Lake Tahoe.
 
Action to be taken following Board approval:
1)      Chairman to sign Agreement 383-S0811, Amendment I.
2)      One original executed agreement shall be returned to Probation to be forwarded to vendor.
