Fiscal Impact/Change to Net County Cost:  No change. The Agreement is funded by Federal and State dollars with required County match met primarily with realignment resources.  Funds were budgeted in prior fiscal years, are budgeted for FY 2008-09 and will be budgeted for FY 2009-10.
 
Background: The County Purchasing Agent executed Agreement 610-S0711 in the not-to-exceed amount of $37,500 on June 13, 2007 for the term May 24, 2007 through December 31, 2007.  The Board of Supervisors executed Amendment I to Agreement 610-S0711 on April 29, 2008, increasing the maximum compensation to $75,000 and extending the term through June 30, 2010.
 
Reason for Recommendation: The provision of therapeutic counseling, inpatient and outpatient substance abuse testing and other related services has proven to be a successful tool for promoting reunification of families served by the Department of Human Services (DHS).  Contracting out to local vendors continues to be the most efficient and cost effective method of delivering these services to eligible DHS clients.  This Agreement is being submitted to increase the maximum compensation to cover higher than initially projected usage over the remaining term of the Agreement.  DHS has experienced a significant increase in the demand for Child Protective Services, Employment Services and other mandated services as a result of the current economic environment, and Sierra Recovery offers certain services that are not available from other vendors in the Tahoe Basin.  Articles related to "Scope of Services" and "Notice to Parties" were also amended to reflect changes in standardized language and format.
 
Purchasing Agent Recommendations:  
The County Purchasing Agent has reviewed the Department's request to amend this Agreement and concurs that it is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5 and 7.10.  The Purchasing Agent has determined that it is appropriate to dispense with any competitive selection process for services performed by Sierra Recovery Center as the Department contracts with multiple firms for specialized treatment services.  Outside review of the contractor's qualifications to perform the needed services was coordinated with the Health Services Department.
 
Action to be taken following Board approval:
1.      Chairman to sign two (2) original Agreements
2.   Board Clerk to return one (1) original Agreement to Human Services at 3057 Briw Road.
3.   Department to distribute as appropriate.
