Sheriff's Department recommending the Board appoint a vehicle abatement hearing officer per Ordinance 4676.

Background: On October 24, 2006, Agenda file 06-1528, the Board of Supervisors approved the amendment of Ordinance Nos. 4706 and 4707 amending El Dorado County Code Enforcement Ordinance 09.02 and Vehicle Abatement Ordinance 10.16 transferring all components of vehicle abatement enforcement to the Sheriff's Vehicle Abatement Unit.
 
Reason for Recommendation:  With the approval of the above mentioned agenda item, it was expected that the function for vehicle abatement hearings would be moved to the Sheriff's Department; however, that function never transferred.  With the recent reductions in force in the Development Services Department, where the hearing officer has been located as part of Code Enforcement, it is now critical that the hearing officer be located in the Sheriff's Department.
 
The Vehicle Abatement Ordinance, section 10.16.070 Request for Public Hearing, states that the Vehicle Abatement hearing officer will be designated by the Board of Supervisors.  That designation was not done in the October 24, 2006 agenda item.  The Sheriff's Department requests approval from the Board to assign an unspecified Lieutenant from their Patrol Division on a rotating basis to perform this function as the Board's designee.
 
Action to be taken following Board approval:  The Sheriff's Department will assign a Lieutenant from the Patrol Division and assume the function of performing Vehicle Abatement hearings.
