Community Development Services, Environmental Management Department (Environmental Management), recommending the Board approve and authorize the Chair to sign the First Amendment (Amendment 1) to Agreement for Services 513-S1510 (Agreement) with Waste Connections of California, Inc., doing business as El Dorado Disposal (El Dorado Disposal), to extend the term of the Agreement for one additional year through August 26, 2019, increase the not-to-exceed compensation amount by $60,000 for a total not-to-exceed amount of $120,000, include a new fee schedule with a 3.5% rate increase to the disposal charge per ton to cover the additional term, and to include other minor administrative changes as necessary, to provide services for the removal, transportation, and disposal of dewatered sewage septic sludge from the County’s Union Mine Wastewater Treatment Plant (Treatment Plant).

 

DISCUSSION / BACKGROUND

On August 27, 2015, the Purchasing Agent approved the Agreement with EL Dorado Disposal, with a three-year term with a not-to-exceed amount of $60,000, to provide services for the removal, transportation, and disposal of dewatered sewage septic sludge from the Treatment Plant for Environmental Management on an as-needed basis.

 

During periods of rainfall, Environmental Management is unable to dispose of dewatered sewage septic sludge on-site and must have the material transported off-site for disposal. Due to weather conditions resulting in increased rainfall during the winter of 2017, Environmental Management had to utilize the services under this Agreement more than what was anticipated. With unpredictable weather conditions for the coming months, Environmental Management anticipates having to utilize the services beyond what is available under the Agreement’s remaining budget. 

 

The proposed increase of the not-to-exceed amount and the extended term under this proposed Amendment 1 will allow for sufficient funding for Environmental Management to continue to utilize these services during the winters of 17/18 and 18/19. Under Exhibit B, Fee Schedule, to the Agreement, El Dorado Disposal was authorized to increase the disposal charge per ton by 3.5% each year for the term of the Agreement. Under the proposed Amendment 1, El Dorado Disposal will be allowed the same 3.5% rate increase for the disposal charge per ton during the fourth year of the term.

 

ALTERNATIVES

The Board may choose to deny the approval of the proposed Amendment 1. This would result in the Agreement running out of funds and Environmental Management being unable to utilize these services. Without a method for disposing of dewatered sewage septic sludge from the Treatment Plant, Environmental Management would also be unable to accept septic sludge from waste haulers throughout the County. 

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

County Counsel and Risk Management have approved the proposed Amendment 1.

 

CAO RECOMMENDATION

 It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

There is no change to the Net County Cost associated with this item. The adopted Fiscal Year 2017-18 budget includes sufficient funding for this amended Agreement. Future proposed budgets will also include funding for these services under a future agreement, following the solicitation for proposals to be conducted by Environmental Management prior to the expiration of this Amendment 1.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board will obtain the Chair's signature on two (2) original copies of Amendment 1.

2) Clerk of the Board will forward one (1) fully-executed original copy of Amendment 1 to the Community Development Services, Contracts and Procurement Unit, for further processing.
