DEPARTMENT RECOMMENDATION: 

Health and Human Services Agency (HHSA) recommending the Board approve Agreement for Services 323-S1810 (Agreement) with Natalie Patterson for the provision of registered dietitian services for the Senior Nutrition Program, ensuring HHSA meets the requirements as set forth by the California Department of Aging.

 

Additionally, HHSA has determined, in accordance with County Ordinance Section 3.13.030, it is more economical and feasible to engage an independent contractor for registered dietitian services.

 

DISCUSSION / BACKGROUND:

HHSA’s congregate meal program provides seniors with hot, nutritious meals every weekday in congregate meal sites located throughout El Dorado County. In addition, if individuals are medically or physically disabled, meals may be delivered to their homes. Eligibility for participation in the congregate meal program or home delivered meal program includes any older person (age 60 or older), the spouse of an older individual, and persons with a disability under the age of 60 who reside in housing facilities occupied primarily by older individuals in which congregate meals are provided, or a disabled person under the age of 60 who attends a congregate meal site with an older individual who participates in the dining program.

 

Under the funding agreement with the State of California Department of Aging, HHSA’s 2016-2020 Area Plan for Senior Services in El Dorado County, and Title 22, all require HHSA to contract with a registered dietitian for the provision of services relative to the Senior Nutrition Program’s congregate and home-delivered meal programs, and as requested nutrition education/nutrition related services.

 

On November 25, 2014, the Purchasing Agent executed Agreement for Services 222-S1510 with registered dietitian Natalie Patterson, for a two-year term that commenced upon execution.  In June 2015, HHSA’s Senior Nutrition Program was audited by the California Department of Aging (CDA). As part of the corrective action, CDA required contract language revisions to the registered dietitian. Included in the findings, CDA indicated contract terms must be for a one-year term but may include the option to renew for successive one-year periods up to a maximum of three (3) additional years.  Although HHSA worked with CDA to satisfy the requirements of the corrective action, CDA determined in 2017 that the resulting Agreement for Services 156-S1611, approved by the Board on November 17, 2015 (File ID 15-1203, No. 14), did not meet the requirement for the term of contract awards.  Subsequently, CDA directed HHSA to prepare another revised agreement with the registered dietitian.

 

After many discussions with CDA’s representative on acceptable wording for a multi-year agreement, HHSA received written approval for new wording from CDA.  HHSA is now recommending the Board approve Agreement for Services 323-S1810 that contains the required language regarding the term of the agreement.  Upon final signature, Agreement for Services 323-S1810 terminates existing Agreement for Services 156-S1611.

 

ALTERNATIVES:

Disapproval of Agreement for Services 323-S1810 will result in HHSA being out of compliance with the funding agreement and the audit findings completed by CDA.

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT:

There is no Net County Cost associated with this Agenda item.  Sufficient appropriations were included in the Fiscal Year 2017-2018 Budget, and will be included in future budgets for the term of the Agreement.

1) Clerk of the Board to obtain signature of Chair on two (2) originals of Agreement for Services 323-S1810.

2) Clerk of the Board to return one (1) fully executed Agreement to the HHSA Contracts Unit at 3057 Briw Road.
