Fiscal Impact/Change to Net County Cost:  The cost of the retrofit device and installation is $19,275.73.  Grant funding in the amount of $10,926 will be provided by the Air Resources Board with the balance of $8,349.73 provided by the Road Fund.
 
Background: On July 26, 2007 the Air Resources Board approved a regulation to reduce emissions from existing off-road diesel vehicles in California.  On March 4, 2008, item # 14, your Board approved Agreement number 07-1601 with Smith Power Products, Inc. to retrofit and re-power specific Department of Transportation equipment in order to  comply with the off-road ARB regulations.  The work under the original Agreement in the amount of $631,100, $408,485 of which was funded by the ARB, has been completed.  
 
Reason for Recommendation:  The purpose of this Amendment is to add one unit of equipment to the schedule of equipment to be retrofitted, and to increase the compensation amount by $19,275.73 for the additional retrofit device and installation. There are no other changes to the Agreement.
 
This Amendment is necessary to allow the Contractor to install a retrofit device required by the Air Resources Board (ARB) on a backhoe recently purchased by the Department (2008 John Deere 310SJ; #56-07).  It was necessary to replace the 1990 backhoe the Department has been operating in order to comply with the emission reduction regulation.  The ARB is providing approximately 74% of the funding for the purchase of the backhoe and requires installation of a retrofit device in order to qualify for the grant funding. The ARB is providing approximately 57% of the funding for installation of the retrofit device.  
 
The Purchasing Agent reviewed the request to contract with Smith Power Products, Inc. on December 18, 2007 when the original Agreement was processed and provided approval to dispense with outside review and competitive selection because the Contractor is the only qualified installer of the retrofit device that is approved by the ARB.  The Department requested the Purchasing Agent's concurrence with the Department's decision to amend this Agreement on January 21, 2009.  
 
The total amount of the Agreement and Amendment I is $650,376.03.  The majority of this cost is attributable to actual equipment and parts, with $157,854 being labor for installation. On January 23, 2009, Human Resources provided their approval to proceed with this Agreement.  
 
Action to be taken following Board approval:  The Board of Supervisors will return one fully executed Agreement 07-1601 to the Department of Transportation for further processing.
