The Elections Department recommending the Board approve and authorize the Purchasing Agent to execute Agreement #2587 with Dominion Voting Systems, Inc. in a total amount of $23,697.12, for Software License Agreement of the GEMS ballot counting system, with a retroactive effective date of March 1, 2018 through February 28, 2020 (initial period) with an option to extend by one year to February 28, 2021.


DISCUSSION / BACKGROUND
Dominion Voting Systems has provided the GEMS Software License to the Elections Department since 2015. Federal funds (CFDA Number 90.401) administered by the U.S. Elections Administration Commission (EAC) are assisting counties in complying with the requirements of Section 301 of the Help America Vote Act of 2002. The term of this federal funding agreement was extended through June 30, 2021.

Due to the annual agreement amount, this agreement would normally not require Board approval. However, due to uncertainty regarding the required signatures, the agreement was not executed prior to its effective date of March 1, making this a retroactive agreement. Based on County procedures, all retroactive agreements are being presented to the Board for consideration and approval.
