None. There is no net cost to the County General Fund associated with this agenda item.

Reason for Recommendation:
On February 28, 1997, drainage and public utilities easements, as shown on Parcel Map 46-49, were dedicated to the County of El Dorado. Said offer for public utilities easements was accepted, but said offer for drainage easements was rejected on July 3, 1997. Said Parcel Map was recorded on July 9, 1997. Although the drainage easements were rejected, the offer is open in perpetuity and runs with the land.

On January 30, 2001, the County of El Dorado Board of Supervisors adopted Resolution of Vacation No. 024-2001, abandoning the public utilities easements. However, due to a clerical error, the overlapping drainage easements were not included in said Resolution.

A request has been submitted by GHS Academy, a California Nonprofit Public Benefit Corporation, owner of Assessor's Parcel Numbers 117-100-30, requesting that the County of El Dorado Board of Supervisors vacate the drainage easements located on the subject property, as originally intended. Said action is necessary in order to eliminate unneccessary encumbrances. Said easements are more particularly described in Exhibit A and depicted in Exhibit B of Official Record Document #2001-0005424, attached to the new Resolution.

The Department of Transportation’s staff has reviewed the request, has no objection and recommends the Board approve and adopt the Resolution of Vacation terminating and abandoning the rejected offer for drainage easements.
