Reason for Recommendation:
The Department of Transportation (DOT) is working to advance the Environmental Improvement Program (EIP) Project for the Christmas Valley 2 Erosion Control Project.  The project will provide drainage improvements to improve water quality and soil conservation.

The project is subject to the California Environmental Quality Act (CEQA).  The preparation of a CEQA Mitigated Negative Declaration has been completed and on February 24, 2009 your Board adopted and approved the project as described in the CEQA document.

The research of the potentially affected parcels and the acquisition of land rights affecting portions of the subject parcels are necessary from the subject property owners to enable the construction of the project.  In order for DOT to prepare for negotiations with the subject parcel owners, DOT staff is requesting authorization from your Board to proceed with the acquisition process, including the ordering of, and payment for, title reports and obtaining certified appraisals of the land rights to be acquired.

Action to be taken following Board approval:
Right of Way Unit staff to proceed with the acquisition process for the subject parcels referenced herein, including the ordering of, and payment for, title reports and obtaining certified appraisals for portions of the subject parcels necessary to construct the project.
