DEPARTMENT RECOMMENDATION

Chief Administrative Office recommends the Board approve the budget transfer in order to process any remaining FY 2017-18 payments.  An invoice for FY 2016-17 services was received by the CAO Fiscal in September 2017 and processed against the FY 2017-18 budget.  The FY 2016-17 expenses were unanticipated and as a result were not accrued.  The Alternate Dispute Resolution Special Revenue Fund does not currently have sufficient appropriations to process the remaining FY 2017-18 payments.

 

DISCUSSION / BACKGROUND

The Dispute Resolution Program Act of 1986 provides for the establishment and funding, at County option, of local dispute resolution programs.  The goal of dispute resolution programs is to create a more effective and efficient dispute resolution process by offering less threatening and more flexible forums for persons of all ethnic, racial, and socioeconomic backgrounds.

 

In July 2017, the Board approved and authorized the CAO to execute an agreement with the Superior Court of California, County of El Dorado, for the provision of alternate dispute resolution (ADR) services in an amount not to exceed $410,000 for a five-year period (reference Agenda File 12-1405). The FY 2016-17 payment was processed against ADR Agreement 339-S1311, which expired June 30, 2017.  There is no impact to the current Agreement. 

 

Approval of this request would increase appropriations by $22,000, for a total of budgeted amount of $96,000, so that all FY 2017-18 contracted payments may be issued.

 

ALTERNATIVES

The Board could choose to not approve the budget transfer, however, the department would be unable to issue any remaining contract payments for FY 2017-18 services.

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

In FY 2017-18, $74,000 was budgeted for the current ADR Agreement. Approval of this budget transfer would increase the revenue (by increasing the use of fund balance in the fund) and appropriations in the special revenue fund by $22,000. All costs associated with this program are paid from special revenue funds received by the County from the court filing fees and the El Dorado County Superior Court, so this request would not result in an impact to Net County Cost.
