Fiscal Impact/Change to Net County Cost:
Funding for the Project will come from the TIM fee program, STIP funds, SHOPP funds, and MC & FP funds.  There is no net cost to the County General Fund associated with this agenda item.
 
Background:
On January 30, 2007, your Board approved the Acquisition Agreement for Public Purposes (Acquisition Agreement) to enable the acquisition of land rights affecting portions of the Prospector's Plaza, owned by WRI Golden State LLC.  The land rights acquired included fee and easements, in order to widen Missouri Flat Road and allow for the reconstruction/expansion of the westbound on-ramp onto U.S. Highway 50 from Missouri Flat Road. These acquired land rights were for Phase 1A and Phase 1B of the project, and Phase 1A of the project has been completed. Also included in the Acquistion Agreement was a provision for the relocation of the TOMRA recycling center; the excerpted pages from the Acquisition Agreement related to the relocation are shown on Attachment D.
 
In Phase 1B of the project, the TOMRA Recycling Center, which is currently located in the parking lot of the KMart store and adjacent to the current U.S. Hwy. 50 westbound on-ramp, will have to be temporarily relocated to allow for the construction of the newly aligned westbound on-ramp.  The Recycling Center will be temporarily relocated further west, next to the KMart Garden Center, within the shopping center parking lot to accomodate this realignment.  Once the construction work to the westbound on-ramp area has been completed, the Recycling Center will be moved back to within 15 feet of its current location, adjusting for the new alignment of the on-ramp.
 
The Uniform Relocation Assistance and Real Properties Acquisition Policies Act of 1970 as amended (Uniform Act) will be followed in performing this temporary relocation.  R/W Unit staff originally estimated that the cost to relocate the Recycling Center to it's temporary location and then move it back to its current location would not exceed $25,000.  In meeting with the TOMRA Recycling Center management, it has been deemed most beneficial to the County and the Recycling Center to have the relocations performed by TOMRA Recycling Center Corporate, due to the fact that the Recycling Centers are portable and are moved in and out of shopping centers, as needed, on a regular basis as part of the specialized TOMRA Corporate business model.  Therefore, TOMRA Corporate presents the County with a substantial cost savings by completing the work themselves.  
 
To temporarily relocate the Recycling Center further west within the Prospector's Plaza Shopping Center, the reimbursement cost is $5,425 and includes forklift rental and transport, labor for a two man crew and an electrician to place temporary power to the new location.  To permanently relocate the Recycling Center back to its approximate original location, the reimbursement cost is an additional $7,425 and includes forklift rental and transport, labor for a two man crew and an electrician  for permanent power to the final permanent location. The total reimbursement not to exceed cost for the relocations is $12,850 as shown on Attachment A and B.
 
Reason for Recommendation:
The TOMRA Recycling Center is currently located in an area that will become a fill slope for the new U.S. Hwy. 50 westbound on-ramp.  The temporary relocation must occur before Phase 1B construction of the new alignment of the westbound on-ramp is started, and the final relocation must occur upon completion of the Phase 1B highway construction.
 
Action to be taken following Board approval:
 
1.) DOT R/W Unit staff to process a reimbursement payment to TOMRA Recycling Center in the not to exceed amount of $5,425 upon completion of the initial temporary relocation of the facility.
 
2.) DOT R/W Unit staff to process a reimbursement payment to TOMRA Recycling Center in the not to exceed amount of $7,425 upon completion of the final relocation of the facility.
