Title: Health and Human Services Agency, Sheriff's Office, and Probation Department recommending the Board consider the following: 1) Approve and authorize the Chair to sign Amendment 6 to Agreement for Services 76 with California Forensic Medical Group for the provision of health services in the two jail facilities and the two juvenile detention facilities, thereby extending the term for a period of six months to be July 1, 2013 through December 31, 2018, and increasing the maximum obligation of the Agreement by $1,901,622.32 effective July 1, 2018, for a new total maximum obligation of $12,488,463.73 for the term of the Agreement; and 2) Authorize the Purchasing Agent, or designee, to execute further documents relating to Agreement for Services 76, including amendments which do not increase the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management. Title

Health and Human Services Agency, Sheriff's Office, and Probation Department recommending the Board consider the following:

DEPARTMENT RECOMMENDATION

Health and Human Services Agency (HHSA) recommending the Board approve and authorize the Chair to sign Amendment 6 to Agreement for Services #76 with California Forensic Medical Group for the provision of health services in the two jail facilities and the two juvenile detention facilities.  The intent of this Amendment 6 is to ensure ongoing services while the parties to the Agreement negotiate terms and conditions.

 

Additionally, HHSA has determined, in accordance with County Ordinance Section 3.13.030, it is more economical and feasible to engage an independent contractor to provide licensed healthcare professionals trained in correctional medicine.

 

DISCUSSION / BACKGROUND

Pursuant to California Penal Code Section 4011 and California Code of Regulations Title 15, the County is responsible for the provision of health care for detained adults and children.  These services have been provided via contract(s) with CFMG since 2005 when Public Health determined that the provision of medical care to facilities on both slopes was better provided, and more cost effective, using a vendor who specialized in these services. 

 

The Health and Human Services Agency (HHSA), the Sheriff’s Office (EDSO), and the Probation Department (Probation) had prepared a renewal Agreement effective July 1, 2018; however, upon review by Counsel additional items were identified needing to be negotiated, including but not limited to a more defined process for the communication of hospitalizations, and processing of application paperwork for inmates who are eligible to be Medi-Cal beneficiaries. 

 

HHSA, EDSO and Probation therefore are requesting an extension of the current Agreement to ensure sufficient time to address all concerns by the stakeholders in this process.

 

ALTERNATIVES

Disapproval of this Amendment 6 to that Agreement would result in a gap in correctional medical care for the jails and juvenile detention facilities.  Due to limited staffing that is licensed and trained in correctional medicine, disapproval would result in unpredictable future costs for the budget process and the inability to meet standards pursuant to the California Penal Code Section 4011 and California Code of Regulations Title 15.

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

Sufficient appropriations were included in the Department’s Fiscal Year 2018-19 budget.

1) Obtain signature of Chair on two (2) originals of Amendment 6 to Agreement for Services #76.
