Health and Human Services Agency recommending the Board approve and authorize the Chair to sign Amendment 1 to Agreement 456-F1311 (12-89361), and any related forms or documents, with the State of California, Department of Health Care Services, for the provision of specialty mental health services to eligible Medi-Cal clients, retroactively changing the end date of the Agreement from June 30, 2018 to June 30, 2017.

DEPARTMENT RECOMMENDATION: 

Health and Human Services Agency (HHSA) recommending the Board approve retroactive Amendment 1 to Agreement 456-F1311 (12-89361) issued by the California Department of Health Care Services (DHCS).  The Amendment retroactively changes the termination date of Agreement 456-F1311 from June 30, 2018 to June 30, 2017, to avoid any overlap with the retroactive start date of a new Agreement 3190.

 

DISCUSSION / BACKGROUND:

In accordance with Agreement 456-F1311 (12-89361) by and between the County of El Dorado and DHCS, approved by the Board on April 23, 2013 (File ID: 13-0330; Agenda No.9) for a term effective May 1, 2013 through June 30, 2018, the County is designated as the Mental Health Plan (MHP) for the residents of the County, and is thereby responsible for ensuring specialty mental health services are provided to eligible beneficiaries.  Agreement 456-F1311 was considered a revenue agreement and contained an amount for all counties in aggregate.

 

Effective July 1, 2017, new and updated federal Medicaid Managed Care (MMC) regulations were enacted, thereby causing DHCS to develop a new Agreement (FENIX No.) 3190 to ensure compliance with the MMC regulations.  The new Agreement (FENIX No.) 3190 has a retroactive effective date of July 1, 2017, and is being submitted to the Board for consideration this date (File ID 18-1110).

 

On June 6, 2018 HHSA received this Amendment 1 Agreement 456-F1311, which retroactively terminates the current agreement effective June 30, 2017, and was due back to DHCS by June 30, 2018.  On June 15, 2018 County Behavioral Health Directors Association, County Counsels’ Association, and California State Association of Counties submitted a letter of concern to the State regarding both this Amendment 1, and the new MHP Agreement (FENIX No.) 3190.   Subsequently, on or about June 27, 2018, HHSA received notice that DHCS had denied the request to reconsider both the amendment and new agreement.  At that time HHSA took immediate action to process both documents and prepare for the next available Board agenda.

 

ALTERNATIVES:

In the event the Board declines to execute retroactive Amendment 1 to Agreement 456-F1311 with DHCS, two separate MHP agreements will have been in effect for an overlapping period of time (July 1, 2017 through June 30, 2018).  Only the new Agreement (FENIX No.) 3190 contains the new Federal Regulations effective June 30, 2017, thereby creating conflict in governing terms and conditions.

It is recommended that the Board approve this item.
