Fiscal Impact/Change to Net County Cost:  Sufficient funding has been included in the proposed budget for fiscal 2009/2010 to cover the cost of rental equipment.  Federal economic stimulus funds will be used to offset the cost to rent the asphalt milling machine.
 
Reason for Recommendation:  The purpose of the Amendment is to increase the not-to-exceed amount of the Agreement by $50,000, amending Article III, Compensation for Services.  There are no other changes to the Agreement.  
 
This Amendment is necessary to allow the Department to rent an asphalt milling machine to prepare roads for anticipated stimulus-funded overlay work this spring and summer.  The Department is in the process of purchasing a milling machine but the acquisition has taken longer than anticipated.  The department is currently waiting on a 90 day manufacturing and deliver period.  The remaining dollar balance of the Agreement is not sufficient to cover the rental costs of the milling machine prior to the purchase of the new machine.  The rental agreement for this machine is on an as-requested basis which will allow the Department to discontinue rental upon receipt of the purchased machine.  The Department anticipates only needed this rental for two months until the purchased machine is delivered.  The monthly rental costs for the milling machine is $22,000 per month.
 
Action to be taken following Board approval:  The Chairman will sign both originals of the First Amendment to Master Rental Agreement for Equipment Rentals # AGMT 08-1631 and return one to the Department of Transportation for further processing.
