Fiscal Impact/Change to Net County Cost:  Funding is available in the CSA #10 and River Management Program FY 08/09 and projected FY 09/10 Budget.  There is no change in Net County Cost.  
 
 
Background:  The Environmental Management Department is requesting to enter into a Contract with California Laboratory Services (CLS) to provide analytical testing of groundwater, surface water, wastewater, soil, hazardous materials and hazardous waste sample testing for the Union Mine Landfill, Union Mine Wastewater Treatment Facility, Solid Waste and Hazardous Materials Division, Environmental Health Division and the River Management Program.  The Environmental Management Department has had three distinct contracts with CLS for water sampling associated with Hazardous Materials, Union Mine and Environmental Health.  The addition of the River Management Program created a need for additional water testing services.  This contract consolidates all of the Department's water testing services under a single contract.
 
Reason for Recommendation:  The Environmental Management Department has previously contracted with California Laboratory Services laboratory testing services associated with the operation and reporting requirements of the Union Mine Disposal Site.  In addition to the sampling requirements that have been placed upon the Department with the updated Waste Discharge Permit, as adopted by the California Regional Water Quality Control Board, Central Valley Region on January 26, 2006, the Department has absorbed the Hazardous Materials Local Oversight Program from the State as well as the River Management Program from the County's General Services Department.
 
Varying degrees of analytical testing of groundwater, surface water, wastewater, soil, hazardous materials and hazardous waste is required either by law, permit and/or public safety.  In addition to the Union Disposal Site waste discharge requirements, the Environmental Management Department is certified by the State of California Environmental Protection Agency to implement the hazardous materials regulatory programs, including the hazardous materials storage, hazardous waste generator, hazardous waste onsite treatment, underground storage tank programs and the aforementioned Local Oversight Program which concentrates on contaminated site remediation.  The River Management Program, as required by the El Dorado County River Management Plan, samples storm water from Chili Bar to Salmon Falls as a form of mitigation monitoring.
 
In accordance with Board of Supervisor's Policy C-17, Sections, 7.5, and 7.10, the Purchasing Agent has reviewed this request to process the subject agreement with California Laboratory Services and concurs that no competitive selection process is required.  Outside review of the contractor's qualifications took place in May of 2007.  Additionally, the outside reviewer, El Dorado Irrigation District, would not accept the services provided by other laboratories citing lack of consistent testing and poor data quality control.  The Purchasing Agent, with Chief Administrative Office concurrence, has determined that additional outside review is not necessary.  
 
Action to be taken following Board approval:  Forward executed Agreement to the Department for processing.
