DISCUSSION / BACKGROUND

In 2008, responsibility for Court functions was transferred from counties to the State of California.  The Joint Occupancy Agreement (JOA) and the Transfer Agreement (TA) between the Judicial Council of California (Judicial Council) and the County, which governs the shared use of Building C, were signed November 18, 2008.  The JOA and the TA include definitions of Exclusive-Use Areas for both the Judicial Council and the County.

 

Since the JOA and TA were signed, the Judicial Council has developed a need for additional storage space within Building C and the County for locating additional staff within the Permit Center on the main floor of Building C.  It was found to be advantageous for the Judicial Council and the County to exchange an equal amount of floor space within each entity’s Exclusive-Use Area to satisfy both needs.

 

The First Amendment to the JOA and TA also changes references in the JOA to the Judicial Council of California, Administrative Office of the Courts, now known as the Judicial Council of California.

 

ALTERNATIVES

The County could decline to incorporate the changes to the Exclusive-Use Areas, which would require the Judicial Council to find another location for storage of records, and would require the County to find alternate space to house staff serving customers of the Planning and Building Department in the Permit Center.

FINANCIAL IMPACT

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair's signature on two (2) original copies of the First Amendment to the JOA and TA.

2) The Clerk of the Board will forward one (1) fully executed original copy of the First Amendment to the JOA and TA to the CAO Facilities Division, to the attention of Angelo Troquato, for further processing.
