DISCUSSION / BACKGROUND

Pursuant to Government Code Section 66908.3, the California Tahoe Conservancy (CTC) is authorized to lease acquired lands.  When such lands are within El Dorado County and are leased to private individuals or groups, the CTC must transfer 25 percent of the gross income of the leases to the County each year.  Pursuant to the Budget Act of 2018, Chapter 29/18, the California State Legislature has appropriated $3,710 to the CTC for transfer to the County as private lease revenue for this fiscal year.  At least 50 percent of this amount is to be used for erosion control projects in the South Lake Tahoe region, as defined in Government Code Section 66905.5.  Transportation will allocate the entire $3,710 to erosion control projects.

 

California Standard Agreement CTA 18 013 (Agreement) requires that the County sign the Contractor Certification Clause CCC 04/2017 (Certification) regarding non-discrimination, drug-free workplace requirements, and other provisions for which certification is required when doing business with the State of California.  The County's current practices are consistent with these requisites.

 

The term of the Agreement is retroactive from July 1, 2018, and continues for a three-year term ending April 30, 2021.  The requested Board action is retroactive because Transportation did not receive the subject Agreement from the CTC until July 16, 2018.

County Counsel has reviewed and approved the proposed Agreement and Certification.

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

Approval of the Agreement will facilitate the provision of $3,710 for the County's use on erosion control projects in the South Lake Tahoe region.  There is no Net County Cost or match requirement associated with these funds.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on the three (3) originals of the Agreement and Certification.

2) The Clerk of the Board will return all three (3) partially-executed originals, the executed Certification and a certified copy of the Minute Order to Transportation - Tahoe Engineering Unit, Attention: Patty Scott, for further processing to the CTC.
