Title

Community Development Services, Department of Transportation, recommending the Board consider the following:

1) Accept the subdivision improvements for West Valley Village, Lot V (TM 12-1507) as complete as of July 1, 2018;

2) Reduce Performance Bond K09283420 from $3,092,889.10 to $370,860.84, which is ten percent of the total cost of the subdivision improvements (not ten percent of the bond). 3) Hold Laborer and Materialmens Bond K09283420 in the amount of $1,854,304.18 for six (6) months to guarantee payments to persons furnishing labor, materials, or equipment;

4) Accept the bike path improvements for West Valley Village (Blackstone) Class 1 Bike/Pedestrian Trail, Phase 1 and Phase 2 (TM 99-1359) as complete as of July 1, 2018;

5) Reduce Phase 1 Performance Bond 929607009 from $1,269,320.60 to $126,932.06, which is ten percent of the total improvements. This amount guarantees against any defective work, labor done, or defective materials furnished, which is to be released after one year if no claims are made;

6) Hold Phase 1 Laborer and Materialmens Bond 929607009 in the amount of $1,269,320.60 for six (6) months to guarantee payments to persons furnishing labor, materials, or equipment;

7) Authorize the Clerk of the Board to release the aforementioned bonds after the required time periods upon written request from the Department of Transportation; and

8) Authorize the Clerk of the Board to release Phase 2 Performance Bond 929916520 in the amount of $804,401.60 and Phase 2 Laborer and Materialmens Bond 929916520 in the amount of $804,401.60 at this time.  The Phase 2 improvements are secured under the West Valley Village, Lot V Subdivision Improvement Agreement bonds, items 2 and 3 above.

DISCUSSION / BACKGROUND

Lot V

West Valley Village is part of the Valley View Specific Plan, which was approved in December 1998.  The project is located on the northeast side of the intersection of Royal Oaks Drive and Latrobe Road in the El Dorado Hills area. 

 

On July 19, 2016 (Item 34), the Board approved the Subdivision Improvements Agreement for Class 1 Subdivision between County and Owner (SIA), Lennar Homes of California, Inc., for the West Valley Village, Lot V subdivision project, creating a total of 70 residential lots.  The subdivision improvements within West Valley Village Lot V have been completed according to the plans and specifications for this development and per the conditions of the SIA. 

 

Bike/Pedestrian Trail

On January 22, 2004, the Owner, West Valley, LLC, obtained approval of the tentative map TM 99-1359, West Valley Village project now commonly referred to as “Blackstone”.  Condition of Approval No. 61 for the development of the project required the construction of a Class I bicycle and pedestrian trail along the portion of Latrobe Road adjacent to the project site consistent with El Dorado County and El Dorado Hills Community Services District Standards.

 

On September 1, 2015 (Item 14), the Board approved the Bike Path Improvement Agreement for West Valley Village (Blackstone) Class I Bike/Pedestrian Trail Phase 1 and 2 (BPIA). The bike path improvements within West Valley Village (Blackstone) have been completed according to the plans and specifications for this development and per the conditions of the BPIA. 

 

The Department of Transportation (Transportation) in conjunction with the Developer, combined construction of the West Valley Lot “V” improvements with Phases 1 and 2 of the Bike/Pedestrian Trail project for the purposes of efficiency and construction continuity.  As the projects are now complete, they are being presented jointly in this item to streamline tracking and administrating the release of bond securities, and assuring warranty obligations are properly completed.

 

Transportation construction inspection staff inspected the work on these projects and confirms the subdivision improvements and Bike/Pedestrian Trails Phase 1 and Phase 2 improvements were complete as of July 1, 2018.

 

ALTERNATIVES

None; when the Owner/Developer completes all improvements and the County inspects and approves those improvements, the County is then obligated to approve reduction of the Bonds, if necessary, and initiate the warranty period.

1) The Clerk of the Board will reduce West Valley Village, Lot V Performance Bond No. K09283420 to $370,860.84 and advise Transportation (Julie Millard) and the Owner, Lennar Homes of California, Inc., Attn: Larry Gualco, 1420 Rocky Ridge Drive, Suite 320, Roseville, CA 95661, it has been reduced. 

2) The Clerk of the Board will hold West Valley Village, Lot V Laborers & Materialmens Bond No. K09283420 for six (6) months.  If no claims have been filed, Transportation will request in writing that the Clerk of the Board release said Bond.

3) The Clerk of the Board will reduce West Valley Village (Blackstone) Class 1 Bike/Pedestrian Trail, Phase 1 Performance Bond No. 929607009 to $126,932.06 and advise Transportation (Julie Millard) and the Owner, West Valley, LLC, Attn.: Larry Gualco, 1420 Rocky Ridge Drive, Suite 320, Roseville, CA 95661, it has been reduced.
