DISCUSSION / BACKGROUND

The Tahoe Resource Conservation District (TRCD) has performed storm water quality compliance monitoring for El Dorado County (County) since 2013.  Water quality monitoring is required by the County’s Lake Tahoe Municipal National Pollutant Discharge Elimination System (NPDES) Permit (Attachment C of Order R6T-2017-0010, NPDES No. CAG616001). 

 

The purpose of this amendment is to: (1) amend the Agreement to extend the expiration date of December 31, 2018 for three (3) additional years, amending ARTICLE II, Term; and (2) increase the not-to-exceed compensation amount of the Agreement by $136,000, for a total not-to-exceed amount of $179,333, and add a revised Rate Schedule for the remaining term of the Agreement, amending ARTICLE III, Compensation for Services, and adding Amended Exhibit B-1, Amended Rate Schedule and Amended Exhibit C, Amended Cost Estimate.

The underlying Agreement provides for stormwater compliance monitoring services in Lake Tahoe at six (6) predetermined locations around the lake. The total cost of the lake-wide monitoring services will be split equally between the County and the other five (5) participating jurisdictions. Each of the six (6) partnering jurisdictions shall enter into separate agreements with TRCD to cover the services to be provided for this Project. The Agreement and Scope of Work are attached for reference.

 

The monitoring work conducted between 2013 and 2016 was entirely covered by a Southern Nevada Public Lands Management Act (SNPLMA) grant.  The monitoring work conducted between 2016 and 2018 was half covered by a SNPLMA grant, with the County paying the other half.  The SNPLMA funding has since run out and that is the reason that the costs to the County are higher for the requested three year extension. Currently, there are no grants supporting this program as in the past. However, we are researching and exploring grant possibilities to lower the County's costs moving forward.

 

ALTERNATIVES

The Board could choose to not approve the contract amendment.  The Agreement would expire and the County would then be out of compliance with its water quality monitoring requirements outlined in the Lake Tahoe Municipal NPDES Permit.  The County would either have to ramp up to conduct the services in-house, or choose an alternate vendor to supply these services, which are more expensive alternatives.

FINANCIAL IMPACT

There are sufficient funds in the FY 2018-19 budget for the contract. Planning and Building will budget accordingly for future years. The contract amendment adds three years of monitoring work at a price of $136,000.
