Fiscal Impact/Change to Net County Cost:
Funding for this agenda item will be provided by a California Tahoe Conservancy grant.  Funding for the acquisition will be provided by the following sources: California Tahoe Conservancy, US Forest Service, Tahoe Regional Planning Agency (TRPA), and Caltrans Congestion, Mitigation and Air Quality (CMAQ).  There is no net County cost associated with this agenda item.      
 
Reason for Recommendation:
The Department of Transportation (DOT) is currently in the design phase of this project.  The Sawmill 2 Bike Path and Erosion Control Project (Project) is intended to provide a critical link in the Regional Lake Tahoe bicycle path network and to stabilize soil and improve storm water quality within the Project area.  The Project supports the Tahoe Regional Planning Agency's and the Tahoe Metropolitan Planning Organization "Bicycle and Pedestrian Master Plan" by installing a Class I bicycle facility along the south side of Sawmill Road between U.S. Highway 50 and Lake Tahoe Boulevard.  The Project will help improve storm water quality by installing low impact Best Management Practices to treat storm water prior to it discharging to Angora Creek.
 
The Project is subject to the California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA).  The preparation of a CEQA Mitigated Negative Declaration and a NEPA Categorical Exemption is currently underway.  These documents will be presented to your Board at a later date.
 
The research of all potentially affected parcels, and the acquisition of portions of the subject parcels, is necessary from the subject property owners in order to accommodate construction of the Project.  In order for DOT to prepare for negotiations with the subject property owners, DOT staff is requesting authorization from your Board to proceed with the acquisition process, including the ordering of and payment for title reports, and obtaining certified appraisals of the lands rights to be acquired.
 
Action to be taken following Board approval:
Right of Way Unit staff to proceed with the acquisition process for the subject parcels referenced herein, including ordering of and payment for title reports, and obtaining certified appraisals for portions of the subject parcels necessary to construct the Project.
